On Friday, a California federal judge granted preliminary approval to a class action settlement over allegations the outdoor sporting goods retailer Bass Pro Outdoor World LLC illegally recorded customer telephone calls without their consent.
The $6 million class action settlement was preliminarily approved by U.S. District Judge Cynthia Bashant, who found that the proposed deal was reasonable, based on similar class action settlements that were approved in California.
The Bass Pro call recording class action lawsuit was filed by a customer who claimed the retailer recorded at least one call in which he disclosed personal identification and financial information to a customer service representative. The plaintiff claims he was not notified the call would be recorded.
The Bass Pro class action lawsuit alleged the company regularly recorded incoming and outgoing telephone calls without informing customers that the calls would be recorded, in violation of the California Invasion of Privacy Act.
In Friday’s order approving the Bass Pro class action settlement, Judge Bashant conditionally certified a Class of California residents who had at least one phone call with a live Bass Pro customer service representative that was recorded without notification between March 14, 2012 and April 3, 2013.
More than 30,000 customers have been identified as Class Members of the Bass Pro class action settlement based on Bass Pro’s records, but the actual number of eligible Class Members may be higher.
In addition to providing more than $4 million to Class Members, the Bass Pro class action settlement also requires Bass Pro to change its business practices so that it will not record any inbound telephone calls from California area codes without notifying the caller that the call may be recorded. According to the court documents, Bass Pro has not recorded outbound calls to California phone numbers since April 4.
It is not yet certain how much compensation Class Members will be eligible to receive. However, Judge Bashant estimates that Class Members will each receive more than $130, depending on how many eligible Class Members file claims for the Bass Pro call recording class action settlement. A final approval hearing has been scheduled for Dec. 15, 2014.
