A settlement has been reached in a class action lawsuit that alleges former employees of Tampa General Hospital inappropriately accessed patient information.

If you were a patient at Tampa General Hospital and were notified that your patient information may have been inappropriately accessed, you could be entitled to a cash payment and other benefits from the data breach class action settlement.

A plaintiff known only as John Doe filed the class action lawsuit against Florida Health Sciences Center Inc. d/b/a Tampa General Hospital, alleging that one or more former employees of Tampa General Hospital inappropriately accessed patient information. The plaintiff asserts Tampa General Hospital is responsible for the potential losses patients may suffer due to the inappropriate access to their patient information.

According to the class action lawsuit, Tampa General Hospital was aware that unknown individuals wrongfully accessed its computer storage systems, and became aware of this unauthorized access in May 2014. These unknown individuals allegedly accessed and obtained patient information, including their names, addresses, birthdates, Social Security numbers, admitting diagnosis and insurance information.

Doe states that the Tampa General Hospital data breach was discovered after police in Tampa, Fla., arrested someone who possessed Tampa General Hospital patient records even though this person was not a hospital employee. A hospital employee was reportedly terminated after an investigation into the data breach.

The Tampa General Hospital class action lawsuit asserts that the unauthorized access to patient information puts patients at risk of identity theft and financial losses associated with the theft of their personal information. Doe accuses the hospital of failing to adequately safeguard its patients’ personal information.

Florida Health Sciences Center denies the allegations and maintains that it is not responsible for any alleged intentional misconduct by its former employees. However, it has agreed to settle the class action lawsuit to avoid the burden and expense of trial.

The Tampa General Hospital class action settlement received preliminary approval on Oct. 13, 2016.

If you would like to exclude yourself from the Tampa General Hospital settlement, you must do so no later than Jan. 23, 2017. If you would like to object to the class action settlement, you must do so no later than Feb. 21, 2017.

Who’s Eligible

Class Members include “all persons: (1) who received one of three letters (dated August 5, 2013, August 12, 2013, and September 12, 2014) from the Hospital notifying them that they may be at increased risk of identity theft as a result of inappropriate access to their patient information, and (2) whose patient information was inappropriately accessed during the period from December 19, 2009 through December 19, 2014.”

Potential Award

Class Members who suffered a “stolen identity event” and suffered an actual loss as a result of the inappropriate access to their patient information may file a claim to seek reimbursement for their losses.

In addition, Tampa General Hospital will make available one year of credit monitoring to Class Members who make a successful claim for payment.

Proof of Purchase

To make a claim, Class Members must provide documentation of the existence of a “stolen identity event,” documentation showing losses from the event and documentation from a third party stating that any actual losses will not be mitigated.

    i suffered a serious Psychotic episode after taking one Prednisone tablet for pain caused by two Root Canal Surgeries during one dental session. Is there a class action charging Prednisone with causing a Psychotic episode? My physician confirmed that I was one of the persons allergic to Prednisone and that I did, indeed, suffer an uncontrollable Psychotic Episode caused by Prednisone. Does this site have a program to research specific class actions I may have missed or did not fit into at the time of first publication?
