Lowe's class action lawsuit

Lowe’s Home Centers LLC has reached a settlement with the U.S. Equal Employment Opportunity Commission to resolve allegations Lowe’s violated the Americans with Disabilities Act by terminating certain employees.

If you were employed by Lowe’s Home Centers Inc. or Lowe’s HIW Inc. and your employment was terminated between Jan. 1, 2004 and May 13, 2010 after you took the maximum amount of leave available under the company’s leave of absence policies, you may be entitled to compensation from the Lowe’s EEOC settlement.

The settlement will resolve charges filed by three former Lowe’s employees who accuse the company of violating the ADA by terminating their employment. They brought the lawsuits on behalf of themselves and a Class of employees whose medical leave of absence exceeded Lowe’s 180-day (and subsequently, 240-day) maximum leave policy.

Lowe’s denies the allegations but agreed to pay up to $8.6 million to settle the ADA class action lawsuit. In addition to offering compensation to eligible Class Members, Lowe’s has also retained an Equal Employment Opportunity Consultant to review its policies and procedures, develop employee training on ADA compliance and ensure that Lowe’s continues to be compliant with the provisions of the ADA.

UPDATE: On April 7, 2017, Top Class Action viewers started receiving checks in the mail from the Lowe’s EEOC class action settlement worth as much as $12,000!

Who’s Eligible

Class Members include Lowe’s employees who were terminated between Jan. 1, 2004 and May 13, 2010 after taking the maximum amount of leave available under Lowe’s leave of absence policies.

      I filed a claim form but never got a first check but informed delivery is showing something from them on Tuesday. I wrote to them a couple of months ago saying I never received a check and nobody contacted me.

    I lost my check I received. Is there anything I can do to reclaim another one or am i screwed? It was for the Brown Vs. Lowes case. Really could have used that money. any number I could call?

    Anyone have an email address for rust consulting? I received my check today but the 1099-MISC file has the wrong SSN on it, I’m not sure if I should cash it yet, I need them to correct the 1099. Thanks

    I didn’t work for Lowes but I did have the same thing happen to me while I worked at Sears , Sears Holdings at Mansfield, Ohio. I was off for several months and exceeded the alloyed time and could not come back when they said I had to , and the consequences where I lost my job . Have not been able to go back to Sears to date as my job was given to a new employee . I have been on SSDI and was unable to go back but would like to go back in maybe another year .
    Do I have a case , I am not sure !
