BlueGreen Vacations sales tacticsBlueGreen Vacations Unlimited Inc. has been hit with a class action lawsuit that accuses the timeshare company of using “hard sell” tactics and misinformation to convince consumers to enter into timeshare contracts.

Plaintiffs Kyle Miles and Jasmine Miles filed the deceptive sales tactics class action lawsuit against BlueGreen Vacations, claiming that the company engages in “the practice of making and advertising false promises and statements with regards to its timeshare contracts that it had no intention of honoring,” causing consumers to suffer damages.

According to the BlueGreen Vacations class action lawsuit, the plaintiffs attended a timeshare presentation for BlueGreen in Las Vegas, Nev., in December 2014.

“The presentation included other high intensity sales tactics to induce Plaintiffs to enter into a timeshare contract, including claiming the presentation would only last two hours when it in fact lasted over five hours in length,” the BlueGreen Vacations class action lawsuit alleges.

During the timeshare presentation, the plaintiffs were reportedly informed that, if they were not satisfied with the timeshare contracts BlueGreen was selling, BlueGreen would buy back the contracts.

The plaintiffs claim they were told by BlueGreen that the timeshare contract would cost only $15,000 over five years at 15.99% interest. However, BlueGreen’s timeshare contract was for $25,000 over 10 years, the timeshare sales pressure class action lawsuit alleges.

According to the timeshare class action lawsuit, BlueGreen also misled the presentation attendees by representing that the timeshare contract’s maintenance fees would not increase, when in reality, the maintenance fees increase on an annual basis.

After the timeshare presentation, the plaintiffs were reportedly taken into a separate room in which a BlueGreen Vacations agent read them the timeshare contract and had them respond, “I agree.” However, the plaintiffs allege that the terms that were actually contained in the timeshare contract are different than the terms promised during the timeshare presentation.

They also claim that they were pressured to open two BlueGreen credit cards and to put the entire $5,000 down payment on the cards.

The BlueGreen Vacations class action lawsuit alleges that BlueGreen’s “false advertising causes significant and continuing harm to consumers who are unable to sell back their timeshare contracts to BlueGreen despite Defendant’s representations.”

By filing the deceptive sales tactics class action lawsuit, the plaintiffs seek to represent a Class of individuals in the United States who entered into a timeshare contract with BlueGreen after BlueGreen made representations about the ability to sell the contract back to BlueGreen. They also seek to represent a California subclass.

The BlueGreen Vacations class action lawsuit asserts claims for violation of the Florida False Advertising Law, the Florida Deceptive and Unfair Trade Practices Act, the California False Advertising Act, the Consumers Legal Remedies Act, and California’s business and professions code.

    My wife and I purchased in early June, and walking out the door we quickly realized we had made an emotional buying mistake. No matter how much we wanted that “dream vacation” we were not in any position to hold onto this package. During the sales presentation, meeting with the sales representative, and then signing with the authorized agent, we were sold a BlueGreen package. During this 4 hour meeting there was never any mention about contacting the company within 5-10 days to cancel the package. We would have gladly taken advantage of this. I attempted to get in touch with the sales representative within 30 days to discuss my options of getting out of the contract. I was eventually told to get in touch with corporate, which I did, and at that time was told my only option would be to sell which may take months to years.
    We are already regretting our purchase, and would love to get out based on incomplete disclosure of the terms of the contract. They fully took advantage of the fact that the process takes so long, and we had to get back to our children.

      Me too. I even called the next day after losing a night of sleep and I was not told of a grace period for leaving this “club” bc actually you own nothing. It is not a mortgage. I would not attempt to sell it to someone else and put them through this misery.

    This program is terrible. We have paid off our Bluegreen Vacation but have not used this plan at all. We paid this mortgage over seven years. Someone please help us get our money back.

    We were lied to Bought our timeshare at Big Cedar joke Never been able to stay there Had it 18 yrr The biggest mistake we ever made main fees are totally out of site and customer service does not exis

    This has also happened to us. Is there an attorney that can help us get our money back. Been owners for over 4 years has never been able to use one single point. Never any openings. This has been the biggest mistake of our lives.

    My wife and I purchased and was promised many things during the presentation. They laid it all out as to what we would pay for nonalcoholic hotels and what we would pay for BGV stays. I have been going n the site and having difficulty getting into a Bluegreen location after we were told they would be available to us. All the availability are coming under RCI locations. They show us these lavish rooms in the presentation but we have yet to see a Bluegreen room since staying in one in SC. We went to a second presentation in GA where they tried to pressure us into purchasing another 4000 points to upgrade our status which we refused and they were not too happy. We were sitting with one sales rep and another was standing behind us signaling to the rep we were seated with. They are high pressure sells. We have been contracted by people to help us get out of the contract due to the high pressure sales tactics but haven’t made a move on it yet. We are truly not happen with being told one thing and finding out it is not true and some flat out lies. Check before you sign!
