Hyundai stalling defectHyundai Motor America and Hyundai Motor Company have agreed to settle a class action lawsuit accusing the car maker of concealing a stalling defect in certain Santa Fe vehicles, according to documents filed Tuesday in California federal court.

If approved, this Hyundai settlement will resolve a class action lawsuit that was initially filed in 2014 and alleges Hyundai intentionally hid a stalling defect in 2010 through 2012 Santa Fe models that results in a total loss of power, causing the vehicles to experience braking and steering issues.

Plaintiffs Julia Reniger and Greg Battaglia asserted Hyundai violated California’s Unfair Competition Law, Consumer Legal Remedies Act, the federal Magnuson-Moss Warranty Act and the Song-Beverly Consumer Warranty Act.

Hyundai filed a motion to dismiss the Santa Fe class action lawsuit, arguing that the plaintiffs’ claims were moot because they filed their complaint shortly after Hyundai launched a voluntary service campaign to resolve the stalling issues.

U.S. District Judge Samuel Conti denied Hyundai’s motion to dismiss the Santa Fe class action lawsuit in August 2015.

Hyundai denies that the Santa Fe vehicles are defective or that they pose a safety risk. However, the car maker agreed to settle the stalling defect class action lawsuit to avoid the burden, expense and inconvenience of trial. The proposed Hyundai Santa Fe stalling defect settlement was reached after three months of negotiations, according to the settlement documents.

Under the terms of the proposed Hyundai Santa Fe class action settlement, Hyundai will continue to offer a free repair of the stalling issue, and it will offer reimbursement to drivers who paid out of pocket costs to repair the stalling issue. Hyundai will also give Class Members up to $2,000 toward the purchase of a new vehicle. An estimated 77,331 Santa Fe owners may be eligible for benefits from the Hyundai stalling defect class action settlement.

Class Members of the Hyundai stalling defect settlement include “all residents of the United States and the District of Columbia (excluding U.S. territories), who currently own or lease, or previously owned or leased a Class Vehicle that was originally purchased or leased in the United States.” The settlement documents define Class Vehicles as 2010 through 2012 model year Hyundai Santa Fe vehicles with 3.5L engines.

The plaintiffs have asked U.S. District Judge Claudia Wilken to preliminarily approve the Hyundai stalling defect class action settlement. A hearing has been scheduled for Aug. 2, 2016.

    My wife and I bought a slightly used 2010 Hyundai Santa Fe, 3.5L. We shipped it Ghana, West Africa to help us with our work there. For the two years we used the vehicle, we did not experience any stalling issues. However, that has not been the case in the last three years. It literally stalled four or more times in a week. We tried everything possible to solve the problems but so far, no avail. We have contacted Hyundai but the are not offering us any solutions. We are here in Canada for a while, but will be going there soon. We’re asking a solution or suggestions as to how to fix the problem. Any solutions or suggestions?

    I have a 2009 Santa Fe and had this same stalling problem happen today. I was thankfully only going about 35mph when it suddenly and with no warning lost all power. No brakes, no power steering, and engine shut off. I was able to coast into a parking lot and had to put it in park to stop it. Scared the living crap out of me!! It started up with no problem and I drove it about a half mile to the closest repair shop. They at first thought it was the battery or alternator but both were fine. They test drive it and saw no problem. I drove it about home, about 10 miles, with no issues but I’m scared to drive it now. Taking it tomorrow to Hyundai dealer for a more thorough check. I’m the original owner, have about 54k miles, and this is the first problem of any sortbive had with it.

      Hi Lisa I know this was a few years back, but I am currently dealing with this problem with my 2009 santa fe, and before taking it to the dealership was wondering if you remember what they told you the problem was? This sounds identical to what I am dealing with.

    Please tell me how i can be included as I experienced this and no one believed me as a result I was sued after an accident. I said at the time I felt like I had no power, my brakes locked up and steering very difficult. I had once before briefly experienced it without issue and felt a power surge when the issue I would assume now resolved itself. I had spoke to a local dealer who claimed to run a computer test on the car before I had the accident when I thought something was going on to be told no problems were found. I knew this was not right and was ignored by the corporation. This infuriates me as I could not afford another car and was reliant on others. This took a serious toll on me emotionally, physically and financially. Relieved to see this and have a little vindication but need to be included!

    I have a 2008 hundyi Santafe limited that had these same problems. It cost me out of pocket 517.00 to fix it. When o spoke to the corporate affairs on this safty issues they blew me off and would not reimburses me. Can I file in this class action suit
