A settlement has been proposed in a class action lawsuit alleging Credit Acceptance Corporation obtained default judgments that are invalid under Arkansas law. If a default judgment was entered against you in favor of Credit Acceptance Corporation by an Arkansas court, you may be entitled to benefits from this class action settlement.
If approved, this proposed settlement would resolve a class action lawsuit filed by plaintiffs Jerry Stivers and Bessie Stivers, who claim that Credit Acceptance sent summonses that listed an incorrect amount of time for an incarcerated defendant to respond to the debt collection lawsuit.
According to the Credit Acceptance class action lawsuit, the summonses indicated that incarcerated defendants had 30 days to file a written answer. However, under Arkansas law, incarcerated defendants have up to 60 days to file an answer. The plaintiffs claim these summonses should be set aside as void and assert that Credit Acceptance should provide restitution to Class Members from whom they collected money.
Credit Acceptance denies any wrongdoing but agreed to settle the improper debt collection class action lawsuit to avoid the expense and uncertainty of ongoing litigation.
Class Members who wish to opt out of the Credit Acceptance settlement must submit a written request for exclusion, postmarked no later than June 24, 2016. If you wish to object to the Credit Acceptance class action settlement, you must do so no later than June 30, 2016.
Who’s Eligible
Class Members of the Credit Acceptance settlement include “all Arkansas residents who, since January 1, 2004, were (1) defendants to a debt collection civil action filed by Credit Acceptance in an Arkansas court, (2) wherein a Summons was issued incorrectly advising the defendant that an incarcerated person must file an answer within 30 days, and (3) where the defendant had a Default Judgment entered against him or her and in favor of Credit Acceptance.”
Potential Award
$1,000.
Under the terms of the Credit Acceptance settlement, Class Members who file timely and valid Claim Forms will be entitled to a credit of $1,000 to be applied to the amount owed under the Default Judgment in favor of Credit Acceptance.
If less than $1,000 is owed, credit will be applied to satisfy the Default Judgment and the remaining balance will be paid to the Class Member.

N/A. If you received notice of the Credit Acceptance settlement in the mail, you must provide the Mail Notice ID number and Confirmation Code that was included in the notice.
If you did not receive a Mail Notice and you wish to submit your claim electronically, you must provide your Credit Acceptance account number. The Settlement Administrator will send you a confirmation code so you can securely submit a W-9 form with your Claim Form.
If you don’t know your Credit Acceptance account number, you must download a Claim Form, fill it out and mail it to the Settlement Administrator for consideration.

They are the worst had a kill switch put on the car which cost close to $7000 to repair played games about fixing the car….i took the car back to dealer car was missing over a month now it on my credit as a repo….
