BMW-MINI-Cooper

A settlement has been reached between BMW of North America and the Class of consumers who allege that the water pump in their MINI Cooper suffered from defects concealed by the manufacturer.

Plaintiff Trish Herremans originally filed the class action lawsuit in March 2014 alleging that a design defect present in the water pumps of 2007 to 2013 MINI Coopers caused the part to fail.

As a result of the water pump failure, the engines overheated and stalled in response, according to the claim.

Herremans alleged that her water pump failed twice and said she had to pay $1,700 for the repairs since the warranty on her car had expired.

Initially, the class action lawsuit was successfully dismissed by BMW. However, following Herremans’ amended complaint filed in March 2015, BMW responded by agreeing to participate in mediation to resolve the claims.

Both parties agreed to the terms of the settlement following a successful mediation.

BMW continues to deny any wrongdoing, and entered into a settlement to avoid further cost, time and uncertainty associated with future litigation of the case.

Under the terms of the settlement, BMW agreed to compensate consumers for any repairs made to replace the water pump in 2007 to 2013 MINI Coopers. Eligible Class Members will receive up to $500 for any repairs already completed.

Should any other individuals experience water pump failure in their MINI Cooper vehicles during the Settlement Warranty Period, the part will be replaced at no charge to the owner or lessee and can be taken directly to a dealership for repair.

BMW has also agreed to pay an additional $692,500 in attorneys fees and costs and a service award in the amount of $2,500 to Herremans for her service as Class Representative in the MINI Cooper class action lawsuit.

Individuals who choose to exclude themselves from the settlement or object to the settlement must do so no later than Aug. 26, 2016.

Who’s Eligible

All U.S. residents (including Puerto Rico) who currently own or lease, or who have previously owned a Class vehicle defined as follows:

  • MINI R55, R56, R57, R58, R59 and R60 vehicles
  • Manufactured between October 2006 and November 2012
  • All vehicles must have been registered and operated in the U.S. or Puerto Rico
Potential Award

Up to $500.

BMW will reimburse for the lesser of the two as follows: 1) actual cost of the water pump repair for the MINI Cooper or 2) Maximum reimbursement of $500.

Proof of Purchase

In addition to a Claim Form filled out in its entirety under penalty of perjury, eligible claimants must also provide the following:

  • An invoice or repair order for a Water Pump that includes the Vehicle Identification Number (VIN) of the vehicle
  • A description of the parts replaced, as well as labor costs
  • Proof of the actual out-of-pocket costs incurred by the Class Member in the form of a receipt, canceled check, credit card statement, etc.

    I am currently getting my second water pump replaced in less than 3 years!! This case should be opened!! Unacceptable!! And MINI makes it know “OH WELL” pay out of pocket, who treats their customers like such??!

    I have a 2008 Mini Cooper S with 70,000 miles. I now have engine damage due to a bad water pump. Why is there a deadline for claims?

    Our 2011 Mini Cooper S had failed water pump at 74,000 miles and we took it to a Mini dealership in Birmingham Alabama and they refused to fix vehicle stating that time frame is past even though we meet the miles criteria. They charged us more than $1300 for repair of water pump gaskets and hose. We feel truly robbed, but paid for repair otherwise completely out of a vehicle.

    Good afternoon: my name is Pedro Ivan Medina, I had a Mini Cooper 2010 and received the documents for claim Bohemia’s v. BMW, I changed the fuel pump the cost was two thousand dollars aprox in third party repair shop but I don’t have evidence, was 2 years ago, could I fill the claim for get the reimbursement without invoice ?

    My 2011 is at the repair shop as I speak for the same thing. Why isnt this an open class action? Do they think after a certain date they all will miraculously work? Love my Mini, and the BMW i owned before but this is getting to be too costly and time consuming. Please reopen this case.
