UPDATE 6/14/13: Judge orders arbitration of Travelocity class action complaints.
UPDATE: A federal judge dismissed the online hotel price-fixing class action lawsuit on Feb. 10, 2014.
Dozens of antitrust class action lawsuits accusing Priceline, Expedia, Hilton and others of conspiring with one another to fix the price of hotel rates sold through online travel sites have been combined into a new multidistrict litigation (MDL) in Texas.
The U.S. Judicial Panel on Multidistrict Litigation consolidated two class action lawsuits and more than 20 potential cases in the Northern District of Texas under the name In re: Online Travel Company Hotel Book Antitrust Litigation.
The class action lawsuits accuse Orbitz, Expedia, Hotels.com, Travelocity, Priceline and Booking.com of colluding with major hotel brands to fix the prices of hotel rooms. The alleged scheme allows the online travel retailers to “offer a near identical ‘best price’ guarantee – knowing it is the only price available among competitors,” one of the class action lawsuits says.
The hotels listed as defendants in the online travel price-fixing class action lawsuit include Hilton Worldwide, Marriott, Starwood Hotels & Resorts, Trump International Hotels Group, Kimpton Hotel & Restaurant Group and InterContinental Hotels Group.
The class action lawsuits are seeking to represent consumers nationwide that overpaid for a hotel room booked through one of these travel sites due to the alleged scheme.
The new Online Hotel Price-Fixing Class Action Lawsuit MDL is In re: Online Travel Company Hotel Book Antitrust Litigation, Case No. MDL-2405, U.S. District Court for the Northern District of Texas.
The plaintiffs in the two primary class action lawsuits are represented by Hagens Berman Sobol Shapiro LLP, Federman & Sherwood and Gilman Law LLP.
