Consumers may receive unsolicited text messages or phone calls about buying or selling a home, causing annoyance and difficulty using their phones as intended. The Telephone Consumer Protection Act (TCPA) is a federal law that prohibits unsolicited telemarketing communications, including the spam texts and robocalls used by some real estate companies to seek clients, buyers or sellers. Under the TPCA, consumers who received texts or calls without their consent could file a class action lawsuit and can recover between $500 and $1,500 per violation.

What is the TCPA?

The Telephone Consumer Protection Act (TCPA) is a federal law that protects consumers from harassing telemarketing communications. Under the TCPA, businesses can only contact consumers with telemarketing calls, texts or faxes if they first consent to receive these communications, even if they have an existing business relationship. This includes communications made through automatic dialing systems or those using artificial or pre-recorded voices.

TCPA rules also establish a national Do Not Call Registry, a list where consumers can register their phone numbers to indicate they do not wish to receive telemarketing communications from any business. Companies are required to adhere to these requests within 31 days of a number being registering.

Failure to comply with the TCPA can lead to steep penalties. Businesses that violate the TCPA with spam texts, robocalls or junk faxes can be forced to pay $500 per negligent or accidental violation. If these violations are proven to be willful, each text or call could result in up to $1,500 in damages.

Are home purchasing robocalls illegal?

Real estate companies may use text messages or phone calls to seek business from prospective buyers or sellers. However, when consumers don’t consent to receive these communications, real estate agents and real estate companies may be in violation of the TCPA.

For example, if you receive unsolicited offers to sell your home for cash, or if you receive unsolicited text messages inviting you to speak to real estate representatives regarding an offer to sell your home, those messages may be a violation of the TCPA.
