Allstate agreed to a class action lawsuit settlement of at least $2.2 million to resolve claims that it failed to fully pay New Mexico insurance policyholders after incidents with uninsured motorists.

The settlement benefits Allstate policyholders who were covered under an uninsured/underinsured motorist coverage policy in New Mexico that was first issued or renewed between Jan. 1, 2004, and July 11, 2022, who either paid premiums or who made a claim under UM/UIM coverage and had benefits reduced or denied.

According to the class action lawsuit, Allstate violated New Mexico law by reducing underinsured motorist coverage based on the coverage limits of a third party. Consumers claim that this practice caused them to receive unfairly reduced insurance payouts after accidents.

Allstate is a national insurance company that offers home, motorcycle, RV and other insurance products.

Allstate hasn’t admitted any wrongdoing but agreed to a class action lawsuit settlement to resolve the policyholders claims. Although the full value of the settlement is not known, Allstate will pay at least $2.2 million toward settlement claims. 

Under the terms of the settlement, class members who filed a wrongful death claim with Allstate between Jan. 1, 2014, and July 11, 2022, will have their claims automatically readjusted. 

Policyholders who made an uninsured motorist claim between Jan. 1, 2004, and their first policy renewal after July 11, 2022, may be able to resubmit their claim or have their claim readjusted if Allstate offset their payments due to the coverage limits of a third party.

Class members who were policyholders between Jan. 1, 2004, and July 11, 2022, but did not experience a reduced payment can receive a portion of the premiums they paid for uninsured motorist coverage during this period. Claimants who choose this payment option can receive either 12% of all the premiums they paid for minimum limits, unstacked uninsured motorist coverage or 18% of all premiums paid for all other uninsured motorist coverage. Exact payments will vary, but the total for all claims under this option are limited to $2.2 million. 

The deadline for exclusion and objection is Dec. 6, 2023. 

The final approval hearing for the settlement is scheduled for Feb. 15, 2024

In order to receive settlement benefits, class members must submit a valid claim form by Feb. 5, 2024. Policyholders who previously submitted a wrongful-death claim do not need to file a form to have their claims re-evaluated but may need to file a claim form for other benefits.
