Frontier-Mt. Carroll Mutual Insurance agreed to a class action lawsuit settlement to resolve claims that it illegally reduced property insurance payouts.

The settlement benefits Frontier-Mt. Carroll Mutual Insurance policyholders with commercial or personal property insurance who made a structural loss claim for an Illinois property between Feb. 28, 2020, and Sept. 17, 2021, who had labor depreciation withheld from their actual cash value payments.

Plaintiffs in the class action lawsuit claim Frontier-Mt. Carroll Mutual Insurance wrongfully deducted labor depreciation from property loss claim payments in Illinois. This policy allegedly caused financial damage to consumers and violated Illinois state laws.

Frontier-Mt. Carroll Mutual Insurance is an Illinois-based insurance company that resulted from a 2017 merger between Frontier Mutual and Mt. Carroll Mutual.

Frontier-Mt. Carroll hasn’t admitted any wrongdoing but agreed to pay an undisclosed sum as part of a settlement to resolve the class action lawsuit.

Under the terms of the settlement, class members who haven’t received any compensation for labor depreciation can receive up to 112.5% of the labor depreciation which was withheld from their actual cash value payment. According to the settlement website, the average claim payment for class members who have not had any money returned to them is $1,722.06. 

Class members who already recovered compensation for labor deprecation can receive a one-time payment of between 2.5% and 10% of the labor depreciation that was initially withheld from their actual cash value payment. These payments will vary depending on the amount withheld and the amount of time the depreciation was withheld. The average payment for these class members is $60.40, according to the settlement website.

The deadline for exclusion and objection has passed.

The final approval hearing for the settlement is scheduled for Oct. 26, 2023.

In order to receive benefits under the class action settlement, class members must submit a valid claim form by Dec. 15, 2023.
