Postal Fleet Services Lawsuit Overview:

Postal Fleet Services, Inc., which provides vehicles and drivers to the United States Postal Service, underpaid its hourly workers and refused to pay them their last paycheck after terminating their employment, a new class action lawsuit alleges.

The Postal Fleet Services class action lawsuit was filed in Oklahoma on July 30 by lead Plaintiff Joshua Pair, who alleges that Postal Fleet Services, Inc., the Stageline Company, and Vilano Employment Services, Inc., plus three executives, violated the Fair Labor Standards Act by underpaying truck drivers.

Pair, a driver for PPostal Fleet Services, said that he was hired by the company to drive its trucks for an hourly wage, but he was not paid the federal and state minimum mandated by law.

“Defendants required its truck drivers to work specific pay periods without compensating them for any of the hours worked at their hourly rate of pay, thus refusing to pay these employees the mandated federal and state minimum wage,” the Postal Fleet Services lawsuit reads.

Then, on June 14, the company sent Pair and other truck drivers an email notifying them that Postal Fleet Servicess contracts were being terminated, so the company would not have the money to pay the drivers their final paychecks that ran from May 16 through May 28, 2021.

The claim alleges that Postal Fleet Services knew of its legal responsibility to pay the mandated federal and state minimum wage and pay its workers twice each calendar month, “as such, Defendants’’ violations of the applicable laws are willful and malicious.”

Pair says that the decision to underpay workers was made by management under direction of company executives and personnel.

The Postal Fleet Services lawsuit states that the companies and executives have “engaged in systemic wage and hour violations against their Truck Driver employees.”

“Defendants have caused, contributed to, and perpetuated unpaid wages through common policies, practices, and procedures, including but not limited to common compensation and centralized decision-making.”

Pair wants to represent anyone in Oklahoma who has worked for PLS as a truck driver. He is suing for violations of state wage law and the Fair Labor Standards Act. He seeks certification of the Class, damages, legal fees and costs, interest, and a jury trial.
