A number of trucking companies across the United States, including the Matheson trucking company based in California, may be misclassifying or underpaying their truck drivers in violation of state and federal labor laws.

The Matheson trucking company has been around for nearly 60 years, providing transportation and logistics for a variety of commercial carriers, including the United States Postal Service (USPS).

Unfortunately, Matheson is one of a slew of trucking companies that may be either underpaying or misclassifying their truck drivers.

Working as an owner operator truck driver can be an expensive endeavor. Independent truck drivers face many major expenses, including the purchase or lease of a truck, fuel, insurance, taxes, and more. Many truck drivers want to be independent, and this is valid, but this means that they should maintain the majority of control over their work, such as their schedule, load assignments, and more. If a trucking company is controlling the driver’s schedule, mileage rates, and load assignments, among other things, then the driver may actually be misclassified as an independent contractor when they should be considered an employee. Essentially, it’s about the degree of control that the trucking company has.

The misclassification of employees violates the Federal Labor Standards Act (FLSA), along with individual state labor laws.

    Floater driver for Matheson Postal. WA. Winter of 2021. Team driving. Don’t get to shower while running team from Federal Way, WA. To Warrendale, PA. USPS & back.
    No showers, did not have time.
    97% of the time when we go a pre loaded trailer. We always had problems with the trailers lighting, or leaking Shocks on the rear of the trailer. Very little preventable maintenance at Matherson Postal.
    They said we will pay the ticket. How ever it’s the points on my cdl Not there’s.
    2nd they claim the laws does not apply to them. Due to them being a contractor.

    I worked for Matheson from 11-2020 to April 2021.
    I started with FedEx Air freight from Reno, NV. To Oakland, CA. (Airport)Back to Reno Airport. I hauled Air Freight that was classified as hazmat ie Dry ice. Matheson Postal Did Not Have The CA, NV, Hazmat permits, Let alone the FMCSR book.,Emergency Response book or the Hazmat book in there trucks. Let alone the Hazmat Allegiance permit
    for the US.
    Matheson and his son both told me that they do not need the Hazmat permits. Due to the fact the run US Mail for the Government. My reply was to them. Your a contractor.
    I done this in a month of November December and January. 2020 going into 2021.
    I have document paperwork drivers instruction report for trip #1 USPS Redding, CA February 4th 2021
    The trip starts in Redding,CA. at the USPS in Redding at 1935 HRS. The trip returns
    to Redding the next morning by 0900 what’s funny about it is the truck moves at 1945 to hook the trailer. Do your run. From Redding, CA to Richmond, CA. Fuel in Berkeley, Return to Richmond. Hk the trailer. Head to San Jose, SFO, Oakland, Then head back to Redding. How ever take a 10 min break at 0605 to 0615 in Zamora, CA. Then take your 30 min meal break at 0705 to 0735 in Willows, CA.
    problem with this is 2 things. 1st, Your over your FDOT break by 0315/0330. You should be doing your 30 meal break.
    majority of time you don’t even have time to take the break, Cuz you will not make the deadline at 0900 to the USPS In Redding California because of road construction from San Jose to San Francisco post office on 101 slowed you down to 40 mph losing time. #2 drivers are required by federal DOT to take a mandatory dot 30 minute meal break after 7 hours and 45 minutes of being on duty Madison postal service has me taking the break at 0705 12 hours after being on duty taking a 30-minute meal break Mathesn postal service is already in federal DOT compliance of illegal operations in my eyes. You don’t believe it where do I send the driver instructions report that came out of Oakland California from a Matteson postal terminal!

    Truck Driver for postal in California. We don’t get paid for overtime. Instead they call it Premium pay and part of pay goes towards us rejecting benefits pay. Chagolla.G@gmail.com

    I just work at Matheson postal facility in Atlanta. I was refused pay for days and hours worked because the sign in person spelled my name wrong. Now no one wants to except my calls.

    I worked for Roadtex in 2015 for 6 month’s I was an company employee classified as an independent contractor and had to file an i9 on my taxes.
