The U.S. Equal Employment Opportunity Commission (EEOC) approved a $15 million settlement to resolve claims that the U.S. Marshals Service (USMS) discriminated against African Americans.

The settlement benefits current and former African American deputy U.S. marshals who were subjected to USMS promotion policies under the Merit Promotion Process, Management Directed Reassignments and Headquarter Division assignments between Jan. 23, 1994, and Nov. 27, 2023.

The settlement also benefits current and former African American deputy U.S. marshals, detention enforcement officers or applicants who were subjected to USMS hiring and recruitment policies for deputy U.S. marshal positions between Jan. 23, 1994, and Nov. 27, 2023.

Plaintiffs in the case claim the U.S. Marshals Service discriminated against them based on their race. Because they are African American, the plaintiffs were allegedly denied promotions, employment and other benefits.

The U.S. Marshals Service is a federal law enforcement agency.

The U.S. Marshals Service hasn’t admitted any wrongdoing but agreed to a $15 million settlement to resolve the discrimination claims.

Under the terms of the EEOC settlement, eligible consumers can receive a monetary award. Pro rata payments will be distributed based on eligible backpay, compensatory damages and other factors determined by the settlement administrator. 

No payment estimates are available at this time, but claimants could receive more than $100,000, depending on their eligibility.  

The deadline for objection is Jan. 11, 2024. There is no exclusion deadline for the settlement.

The final approval hearing for the U.S. Marshals EEOC settlement is scheduled for March 20, 2024.

To receive a settlement payment, current and former eligible workers must submit a valid claim form by Jan. 26, 2024.
