DHL Kronos Class Action Lawsuit Overview:

  • Who: A DHL employee filed a class action lawsuit against the courier company.
  • Why: DHL has allegedly failed to properly pay many of its employees for regular and overtime hours since the hack of Kronos, a timeclock and workforce management company, in December 2021.
  • Where: The class action lawsuit was filed in Ohio federal court.

DHL Employee M.T. alleges that DHL has failed to pay non-exempt workers such as himself for all hours worked and/or overtime hours after the company’s timekeeping and payroll systems were affected by the Kronos hack in December 2021

M.T. claims he was paid only portions of the overtime hours he worked and at the incorrect rate. He argues that DHL knows how to pay overtime and that it is required to do so because it routinely paid overtime hours properly before the Kronos hack.

DHL Used Kronos Hack to Exploit ‘Vulnerable Workers,’ Class Action Claims

M.T. alleges that after the Kronos attack, DHL failed to implement an accurate back-up timekeeping and payroll system to properly compensate its employees. For example, DHL could have had its employees and managers report accurate hours, he argues.

After the hack, DHL chose to pay its non-exempt hourly and salaried employees based on “prior pay periods or reduced payroll estimates.”

“DHL pushed the effects of the Kronos hack onto the backs of its most economically vulnerable workers, making sure that it kept the money it owed to those employees in its own pockets,” the class action says, noting that most of these workers “rely on the full and timely payment of their wages to make ends meet.”

M.T. says he hopes that DHL will be found liable for violating federal wage laws. He seeks to recover unpaid wages and other damages, penalties and interest.

M.T. seeks to represent similarly situated DHL employees. The proposed class includes all current or former non-exempt employees of DHL (including its subsidiaries and alter egos), who worked in the United States at any time since Dec. 11, 2021, to the present.

The plaintiff is represented by J. Corey Asay of Morgan & Morgan, P.A. and Matthew S. Parmet of Parmet PC.

The DHL Kronos Class Action Lawsuit is Case No. 2:22-cv-02035, in the U.S. District Court for the Southern District of Ohio Eastern Division at Columbus.

Been a DHL employee for a year and 9 months. They have some many excuses of why I can’t get a full-time position but use ne for a full-time work load. No benefits. Never gotten floating time to put for holidays or anything. The mist I get in a sick hrs is 5.00 and 3.00 vacation hours. I didn’t know it was messed until employees asked me why I never fill out TSAs for upcoming holidays or they force us to leave early. I had to check myself out of the hospital on AMA because I was fearful if losing my job and not having enough money to finally get an apartment and end my homelessness. They were always able to call me in and that include my scheduled off days but they don’t appreciate ir know anything about their employees. That it not right. I’m over it. I don’t even bother with their little celebrations, raffles or anything. It’s crazy.
