Perdue Farms class action lawsuit overview:

  • Who: A contract chicken grower filed a class action lawsuit against Perdue Farms Inc. and Perdue Foods LLC.
  • Why: The worker claims Perdue underpays independent contractors while treating them like employees otherwise.
  • Where: The class action lawsuit was filed in Georgia federal court.

A Perdue broiler chicken grower filed a class action lawsuit against Perdue Farms Inc. and Perdue Foods LLC for allegedly purposely exercising a high level of control over growers while still classifying them as independent contractors in order to avoid administering employee wages and benefits. 

The lead plaintiff is Roger Parker, a South Carolina resident who was a contract grower for Perdue in Georgia through 2019. In addition to accusations of mistreatment that he says are characteristic of being a Perdue grower, Parker claims Perdue terminated his contract “due to” a complaint he made to the U.S. Department of Agriculture about “a potential violation by Perdue of the Packers & Stockyards Act (PSA)” regarding its wages and benefits.

Parker alleges that Perdue retaliated against him by “among other things, denying routine lines of credit while requiring him to make expensive and burdensome upgrades to his farm” and refusing to deliver him flocks. 

Parker seeks to represent a nationwide class of individuals who worked as broiler chicken growers for Perdue Farms Inc. or Perdue Foods LLC at any time between July 21, 2016, and the present. He brings claims of labor law violations, breach of contract, fraud, negligent misrepresentation, unjust enrichment, and unfair and discriminatory practices, 

Perdue ‘dictates’ contract chicken farm ops

Perdue holds growers across the country to nearly identical, “restrictive contracts and guidelines… to dictate nearly every aspect of how they run their farms,” according to the class action complaint. 

Perdue allegedly controls the methods, manner, and timing involved in raising chickens, such as requiring specific “feed, medication, vaccinations, and ‘other supplies,’” such as barns. However, Perdue does not disclose these requirement or guidelines before a grower signs a contract; the grower must rely on recruitment materials that promise “independence” and “the satisfaction of leading your own business[.],” according to court documents. 

Growers are required to work exclusively for Perdue, which “offloads enormous capital costs and financial risks” and debts onto growers, who often must continue to work for Perdue to pay off loans they took out to work for Perdue in the first place, the complaint argues. 

Further, contractors often lose out on wages, and even their jobs, if Perdue deems their work to be unsatisfactory — even if it is carried out to Perdue’s exacting standards, according to the complaint.

    My deceased worked for Perdu for 18 yrs. He was never paid & died not being paid properly& asbestos at Eastern Shore b plant in Va.

    Question for those of you responding, have any of experienced the refusal of birds being put on your farm and then pressuring you on who and how much you would sale your farm for?

    I am the former Mrs. Roger Dale Parker. We were married for 40 years. We started growing for Perdue in 2006. We previously grew for Conagra in North Georgia and Sea Board farms in Chattanooga Tennessee. We had some very successful years in the chicken business. When Perdue took us on as growers we knew what we were getting into. We were seasoned growers. On top of that Roger has heart failure and other issues. So, that left the operation of the farm Up to me. Many many people know who did the daily operations. It was me. My health has suffered tremendously. I got the houses ready for placement. Placed the birds, myself and a Perdue driver., managed the chickens daily, did catch night. His allegations are not true ! This is a very complex situation and his allegations are not true.! Perdue gave us a very opportunity to be successful! Everything has to be managed properly!

    I am the former Mrs. Roger Dale Parker. We were married for 40 years. His claims to “His” labor is not true. I operated the farm on a daily basis. I set up the houses for chicks, picked up birds, cut grass, did catch, caked the houses out the whole nine yards! !!! I lost many hours of sleep and my health has suffered tremendously due to NOT having help. He was either busy with other things that I would be to embarrassed to mention or he was sick. He has heart failure and is disabled. Perdue, Chick delivery drivers and catch crews all know who did the labor. He has no business filing this suit. I’m very surprised Perdue has not contacted me. They gave us every opportunity to be successful. In the chicken business you have to manage your business properly and not buy extravagant “toys”. There is a LOT in our failure that people do not know about. Being on call 24/7 is what you sign up for. Yes, companies do things we sometimes do not like. Upgrades must be made in order to protect your investment! No one likes that. It’s part of it. Our failure was no one’s fault but our own.
    He is not a honest man to say the least!
