7-Eleven Inc. has reached a class action settlement over claims that the company failed to provide a “standalone” notice of background checks to roughly 60,000 job applicants.
Under the terms of the proposed 7-Eleven class action settlement, the convenience store chain will establish a settlement fund of $1,972,500 to compensate Class Members.
An amount of benefits per Class Member has not been specified, but court documents did indicate that each payout would not be more than $550.
Around one third of the settlement fund will likely go to attorneys, and the named plaintiff Edwardo Munoz will request $5,000 for his role in the background check class action lawsuit.
The settlement deal has not received preliminary approval yet, but the hearing for preliminary approval is scheduled for July 15.
7-Eleven does not admit to any wrongdoing, but has agreed to settle the claims to avoid the risks and costs of continuing to litigate the issue.
Attorneys for the Class Members expressed approval of the proposed settlement deal, calling it a strong one.
In his 7-Eleven background check class action lawsuit, Munoz claimed that 7-Eleven violated the Fair Credit Reporting Act by not providing a “standalone” notice to individuals, letting them know that the company would be conducting a background check.
Allegedly, this violation primarily applied to people who applied to work at 7-Eleven, but also affected other people on whom the company conducted a background check.
The Fair Credit Reporting Act requires businesses to provide a clear notice that a background check is going to be conducted, and requires there to be no other information on the same notice, because it might confuse the reader or make the message less clear.
Munoz claims that the notice of background checks that 7-Eleven provided was not a “standalone” document and did not meet the requirements set forth by federal law because it included extraneous, and possibly confusing information.
Munoz argues that 7-Eleven Inc. knew or should have know the requirements of the FCRA, but violated the law nonetheless. Allegedly, the company made a practice of providing insufficient notice of background checks, and this affected many job applicants around the country.
7-Eleven is also facing another lawsuit in New York federal court asserting that the company did not pay minimum wages and overtime, as required by law.
The company attempted to fight that lawsuit by asking that workers be required to produce their tax returns. This request was denied by the judge. According to the judge, the company had not made a sufficient argument for why the tax returns should be brought into court.
