A Walmart class action lawsuit claims that women employees are passed over for promotions and advancement in favor of their male counterparts.

The workers note that in many cases, the male promoted to a higher job ranking had less experience than a female wanting the same position.

This Walmart class action lawsuit filed over discrimination is not the first time that the big box store has been accused of gender bias.

In fact, the Walmart discrimination class action lawsuit alleges that the victims in this case have exhausted all legal remedies available to them.

When a 2011 case over gender discrimination against Walmart was dismissed, the claims remained active within the Equal Employment Opportunity Commission.

In November 2018, the women still involved in the case were given the opportunity to litigate, which they took.

The women who have come together in this Walmart class action lawsuit point out that their instances of discrimination stretch back to the 1990s and 2000s. The plaintiffs also state that the discriminatory practices are still in use at Walmart.

The chief complaint in the lawsuit is that Walmart has violated Title VII of the Civil Rights Act of 1964, which prohibits a company from discriminating against employees based on several factors, including sex.

The women allege direct experiences of open discrimination in the Walmart job bias class action lawsuit, including being told that they could not take on jobs with heavy lifting because only a man could complete those tasks. Another worker says she was informed that she was not suitable for a position because she had children.

Other female employees claim they applied for promotions with ample experience but were passed over repeatedly in favor of male workers.

According to the Walmart class action lawsuit, however, the problem with gender discrimination runs deep within the company.

Women participating in the Walmart discrimination class action lawsuit say they were denied opportunities to attend training programs that would have allowed them to advance further.

The plaintiffs claim that they weren’t even told about these training options whereas men were notified and allowed to participate in these trainings that took the male employees to the next earning and responsibility level within the company.

The lawsuit alleges that Walmart executives do not believe women should be involved at a management level and that these behaviors, while illegal, allowed gender discrimination to persist across all levels inside the company.

The Walmart class action lawsuit also accuses the company of being aware of this problem but failing to take any corrective action with it.

The plaintiffs claim that the company has records of salaried versus hourly employees that will reveal the prominence of discrimination against women workers.

The Walmart female employees are represented by Cathleen Scott and Lindsey Wagner of Scott Wagner and Associates PA, Leslie M. Kroeger, Diana L. Martin, Joseph M. Sellers, and Christine E. Webber of Cohen Milstein Sellers & Toll PLLC.

The Walmart Gender Discrimination Class Action Lawsuit is Francine Radtka, et al. v. Wal-Mart Stores Inc., Case No. 9:19-cv-80153-RNS, in the U.S. District Court for the Southern District of Florida.
