Employees of Intelenet America — now known as Teleperformance Business Services US — may benefit from a $1.7 million class action settlement resolving claims the company didn’t properly pay all wages.

The Class is defined as anyone who worked for Intelenet America LLC, now Teleperformance Business Services US LLC, as an hourly home-based call center worker, including, but not limited to, agents, associates, call center representatives, and travel care professionals, at any point between Sept. 20, 2015, and June 21, 2021, or as an hourly call center worker in a brick-and-mortar call center, including, but not limited to agents, associates, call center representatives, and travel care professionals, at any point between Jan. 27, 2017, and June 21, 2021.

The settlement definition of “At-Home Workers” does not include call center workers who work or worked from home temporarily or permanently due to the COVID-19 pandemic. However, the settlement’s definition of “Brick-And-Mortar Workers” does include call center workers who worked from home temporarily or permanently due to COVID-19.

The plaintiff in a class action lawsuit alleged Intelenet failed to pay overtime wages, including for pre- or post-shift work performed off the clock, in violation of the federal Fair Labor Standards Act (FLSA).

Intelenet denies these claims but has agreed to the settlement.

The company, which provides customer experience, content moderation, market research, and other services, employs about 380,000 people.

Intelenet America Settlement Benefits

Class Members who do not choose to exclude themselves from the Intelenet settlement will receive a payment.

The amount of each Class Member’s payment will be based on the number of weeks they worked; weeks worked after May 15, 2019, will be discounted by 90 percent due to a change in timekeeping policies occurring about that time involving TP Agent.

Class Members will not need to file a claim in order to benefit from the Intelenet settlement.

If the Court grants final approval to the settlement, payments will be mailed to the address at which Class Members received their notice. 

Class Members whose address has changed or those who would like to submit a new W-4 are asked to inform the administrator or Class Counsel.

A final hearing will be held Sept. 8, 2021.

The deadline to object to, opt out of, or dispute the settlement is Sept. 4, 2021.

Who’s Eligible

    any one work with donna fox in the open enrollment group? she refused to fix payroll and time errors saying that it was my own fault and i need to log in early to get paid for being on time (log in unpaid) – i hope they fired her for being cruel.

    I was given a settlement check 3 days ago and it was only for $140.00 I’m not sure if I should have but I cashed it. I was only there for 9 months in 2017.
