wyndham hotels and resorts signA recent class action lawsuit claims that Wyndham takes advantage of property owners at an Arkansas resort.

Wyndham has reportedly been selling real property lots located in the Fairfield Bay Ozark Mountain Lake Resort & Community for at least 45 years.

According to the area’s website, Fairfield Bay is an “outdoor lover’s paradise.”

The amenities at the resort are reportedly comparable to a “five-star resort” and the community is described as “active, engaging, versatile, and accomplished.”

However, individuals who purchase property within the resort community are taken advantage of by deceptive club fees, the Wyndham class action lawsuit states.

Upon purchasing property in the resort community, consumers are allegedly required to join a “club” that involves a monthly fee of $30. Individuals who join the club reportedly “shall be entitled to the rights, privileges, and benefits of a member.”

However, plaintiff Gordon Jackson claims that there are actually no benefits in joining the club. Instead, Wyndham allegedly takes advantage of consumers by forcing them to join a club with literally no benefits.

“Class members pay monthly assessments and receive absolutely nothing of value for their money,” the Wyndham class action lawsuit claims. “When they ask to withdraw from club membership, they are threatened with ruination of their credit rating if they try.”

Jackson estimates that Wyndham may have made millions of dollars from this deceptive practice. With around 300 lots in the Fairfield Bay Ozark Mountain Lake Resort, an average ownership of 30 years, and an average assessment charge of $30 per month, Jackson calculates that Wyndham has collected $3.24 million in club fees.

Additionally, Wyndham reportedly promised various improvements to roads, water, electricity, and other utilities when showing properties to consumers, but these improvements were never made.

Jackson argues that he and other consumers made their purchasing decisions based on these claims by Wyndham. Instead of using the club fees to make improvements, Wyndham reportedly hoarded the money instead where it would not benefit property owners.

The Wyndham resort class action lawsuit claims that Wyndham violates their fiduciary duty to property owners, a relationship that was reportedly created when the property company collected money from consumers and held it “for the benefit of” property owners.

Jackson also claims that Wyndham’s actions constitute unjust enrichment, constructive fraud, and common law fraud.

“Since the time of sale of the lots at the Resort until this date, the fraud by Defendant is continuing in that none of the promised improvements have been made,” the Wyndham class action claims. “The Plaintiff and the Class members continue to be prevented from enjoying and occupying their lots at the Resort.”

Jackson seeks to represent a Class of individuals who purchased real property at in the Fairfield Bay Ozark Mountain Lake Resort & Community and who paid assessments to Wyndham.

The Wyndham class action lawsuit seeks compensatory damages, restitution, actual damages, interest, court costs, and attorneys’ fees.

Jackson and the proposed Class are represented by William P. Creasman of Carney Bates & Pulliam PLLC.

The Wyndham Resort Club Fees Class Action Lawsuit is Jackson v. Wyndham Destinations Inc., Case No. 71CV-19-36, in the Circuit Court of Van Buren County, Arkansas.

    I am interested in joining a class action lawsuit against the timeshare company in Las Vegas, due to their predatory, misleading high pressure and outright untruthful tactics to get me, a single mom, to sign up for their timeshare on 12-21-19. I was on a 2 day get a way with my young daughter for her birthday and was promised free tickets if I went to a 30 minute presentation. That was a lie. More like 5 hours. The woman that approached me promising the tickets told me I would have to say I make 100,000 a year to get the 2 free tickets, that they wouldn’t check and I had to make sure I was single. They tricked me into paying $50 for the tickets and a $50 dollar food voucher that I didn’t even get right then. Not until after I signed up to be a timeshare owner. They did not check my income and didn’t go over what I would be paying per month at what interest rate, or provide documents. I told them I could not afford more than 200 per month. I received a statement where I am expected to pay 400 a month and an annual fee. I cannot afford this. I told them I could not even afford to take vacations. They just kept saying sign her it’s just this and its just that. I could not read the computer screen due to having bad vision and I didn’t have my glasses. I am retiring next year soon and there is no way, I can make these payments and my house payment and monthy bills and food. I have not used any points, nor have made a payment yet. They told me to apply for a credit card to gain points I could use to pay the full maintenance fees, which is not true I found later, then they charged $2,000 to the card. I haven’t even activated it. I sent a certified letter to Vegas and Florida requesting they cancel the contract after 9 days. They refused. It should be against the law for Wyndham associates to harm people this way. I now have a 400 a month payment, maintenance fees for the rest of my life and a credit card debt. My credit will be ruined. I am at a loss. I have become so anxious and depressed.

      I am in the same situation as you. I am actually dealing with an attorney that is helping get rid of this bogus trap they set for us all. I pray that all goes well. I just sued them in Jan of this year. I will keep you all posted.

    Verifiable disabled senior stroke victim wife died then vacation at a Wyndham resort sales tactics unlawful facts including removing seniors wallet taking banking card to move money for a down payment then monthly payments when this person qualified as severe mental incapacity since I was hired by him learning to care for him taking to two attorneys for his protection of stroke again real caregiver trained to provide daily care this. Senior unable to read papers mental incapacity that his own daughters didn’t provide care but allowed their father to remain under my care he stated he wasn’t informed about facts thought he had purchased whole condominium in Las Vegas no fees with additional days promised but unable to use didn’t read what he signed!

    I was scammed by the Club Wyndham Discovery Vacations division. Bought 400000 trial points to use at resorts for $4000. High pressure salesman and sales manager at La Belle location in NOLA. They obviously did not disclose that there was a time limit because my account was deactivated and all points voided. $4000 stolen. When I called the agents were very hateful and unwilling to assist with requested contact information.
