Vivid Seats selling rock concert ticketsVivid Seats allegedly uses a bait-and-switch scheme to take advantage of consumers by promising “the industry’s best ticket prices,” but then charging the original ticket price.

“Our superior relationships with trusted sellers give you an unmatched selection of tickets to the hottest and most exclusive events around the world. And we don’t stop there; we invest in technology to keep our costs low, and pass the savings on to you,” Vivid Seats reportedly claims on its website. “Thanks to this commitment, our ticket prices average lower than those found on any other full-service marketplace.”

Following through on their representations, Vivid Seats allegedly offers various tickets to concerts and sporting events and advertises these seats with a percentage discount.

The Vivid Seats class action says these discounts are advertised directly to consumers through email. The discounts are reportedly also reflected in seat price representations on the company’s website.

Plaintiff Howard Derdiger reportedly experienced this scheme in December 2018. Derdiger says he received an email advertising a 10 percent discount, prompting him to purchase four tickets to a Bob Seger concert totaling $1,269.08.

“The advertisement induced Plaintiff to purchase event tickets because it led Plaintiff to believe that by purchasing the tickets, he was enjoying a discount on a product formerly valued higher,” the Vivid Seat class action lawsuit claims.

However, the scheme soon reared its ugly head. Upon purchasing the tickets, Derdiger realized that his tickets cost $245 a piece instead of the $220 ticket price that was reportedly advertised. He was allegedly not given a refund despite complaining to the company.

The Vivid Seats class action says Derdiger would not have purchased the tickets had he known that the ticket prices were falsely represented. As a result of Vivid Seats’ scheme, he allegedly sustained economic losses by paying the “inflated” ticket prices.

The problem has reportedly affected numerous consumers who flock to review sites in an attempt to air their grievances.

The experiences are reportedly universal: consumers are sent an email code with a discount but are not given the discount when purchasing tickets. One consumer argues that Vivid Seats is a “very shady company” that will “mislead you all over the place.”

Vivid Seat is accused of violating Illinois consumer fraud laws, breach of contract, promissory estoppel, common law fraud, and unjust enrichment.

Derdiger seeks to represent a Class of consumers who purchased event tickets from Vivid Seats which were represented at a discounted or otherwise reduced price.

The Vivid Seat class action lawsuit seeks actual damages, treble damages, disgorgement, injunctive relief, declaratory relief, interest, court costs, and attorneys’ fees.

Derdiger and the proposed Class are represented by William M. Sweetnam and Natasha Singh of Sweetnam LLC.

The Vivid Seat Bait and Switch Class Action Lawsuit is Derdiger v. Vivid Seats LLC, Case No. 1:19-cv-01904, in the U.S. District Court for the Northern District of Illinois.

    Ticketmaster is currently issuing refunds for concerts rescheduled due to covid-19. Vivid Seats will not issue me a refund, even though Ticketmaster is issuing refunds for the same show. When I purchased these tickets, I was trying to buy them through Ticketmaster. While in the queue on Ticketmaster I received a notification that the show was almost sold out. I went on Vivid Seats and saw the ticket prices going up and up every few seconds. So I decided to buy the tickets through Vivid Seats, since it seemed unlikely I would get any through Ticketmaster and so I could get them as cheap as possible since the prices were going up and up every few seconds. How is this legal? How is it legal and how is it possible to have ticket prices go up every few seconds on Vivid Seats while tickets for the same concert are in process of being sold on Ticketmaster in the general sale? I feel like I was tricked into buying these tickets from Vivid Seats with this technique. Clearly a human being was not updating the prices on these tickets every few seconds. Since Ticketmaster is issuing refunds for the same show, I want my refund!!! Add me to the class action law suit please, or start a new one!!!

    Please ad me to the lawsuit. I purchased tickets for an out of state venue that was canceled due to the virus. I called them asking about my refund and was told there would be no problem just a little more time was needed. I just received an email stating I now I have a credit instead, and I have seven days to reply for a refund. The phone number doesn’t work! They have $431.50 of my money they won’t return.

    I’d like to be added to this lawsuit. I bought 3 tickets at $842, and VividSeats will not accept my call or chat. They have now blocked my number. Their latest email states they will not refund me.

    They will not send our money back and it’s been 6 weeks. This has happened to us during the corina virus pandemic and these people are still feeding off people trying to sell tickets to shows that are not gonna be happening

      I’m on the same page now they gave me credit on their account I had to call them back and ask for a full refund make sure you do the same. They doing it without consent.

    Add me to this as well – I have a few situations/ orders that they we’re with Vivid seats that were completely handled wrong and they were totally shady in there dealings. I have the paper work on them as well.

    I would appreciate assistance with this scam of a company. I was purchasing a ballet ticket for January 30, 2020 and they sent me a purchase confirmation email stating that I bought a ticket to a different ballet show on July 4, 2020! I paid using paypal. I contacted Vivid Seats right away and asked to correct the mistake and refund me. Received several rejection emails. I then contacted paypal and they denied my case stating that this is a legit transaction. Now I am stuck with the email (not even a real ticket) for a show I was not planning on going to on July 4th, 2020 and it’s not even clear if there is a real ticket that would await me on that far away date.

    Please add me to the lawsuit. Vivid switched my seats the day of the concert even when I told them we did not want the new tickets. I never accessed the tickets and have been charged.

    I bought seats the the show at the Tacoma Dome for Transiberian Orchestra. In August.
    3 days ago I recieved a call that the $600.00 for 2 seats that I purchased were not available and was made an offer for different seats. I was promised that the replacements were good seats with full view of the stage. I am getting a 250.00 refund. I hope. No clear view of the stage and horrible sound. I walked out 30 minutes into the venue.
    I was ripped off plain and simple. Classic bait and switch. With and order in August I should have had no problem getting the seats I want and they had to have known that the replacement seats were of the worst in the facility
    I want Vivid shut down. How do I join the law suit?
