cbd oil in droppersA recent class action lawsuit claims that JustCBD mislabels their CBD hemp oil as containing more cannabinoids than is accurate.

CBD oil is gaining popularity as an alternative, natural medicinal substance. CBD is a cannabinoid derived from the cannabis or marijuana plant, although many products use CBD oil from hemp plants. Unlike THC, another cannabinoid found in marijuana, CBD is not psychoactive. This means that taking CBD will not give people the “high” feeling associated with THC.

Many people find that CBD oil helps them with pain relief without some of the harsher side effects of narcotics and other pain management drugs.

According to Healthline, CBD may help to relieve pain, reduce anxiety and depression, alleviate cancer-related symptoms, reduce acne, benefit people with neurological disorders, benefit heart health, provide antipsychotic relief, assist in substance abuse treatment, and more.

Harvard Health notes that CBD is not regulated by the U.S. Food and Drug Administration (FDA) meaning that it’s hard to know how safe CBD hemp oil products are and whether or not they are as effective as advertised. Recently, a consumer filed a class action lawsuit alleging that JustCBD products do not contain the amount of cannabidiol oil that is advertised.

JustCBD products are sold by numerous companies, including Just Brands USA Inc., in collaboration with each other. Plaintiff Jesse Gaddis claims that testing of several JustCBD products revealed that they do not have as much CBD in them as advertised.

The JustCBD Liquid Honey Tincture is reportedly advertised as containing 100mg CBD. However, independent lab testing allegedly showed that the product only contains 48.92 mg of CBD, representing an alleged underfill of 51.08 percent. The JustCBD Apple Rings Gummies are reportedly advertised as containing 250 mg CBD per jar, but independent testing of the CBD gummies allegedly failed to detect any CBD at all.

Gaddis claims that this failure to meet advertised CBD levels directly goes against JustCBD’s pledge for honesty and transparency. On the JustCBD website, the defendants reportedly state:

“Looking around we found that the CBD business was consistently misrepresented. At JustCBD we believe that you have the right to know exactly what is inside your CBD products. It is our mission and promise to never misrepresent the content of our products. With the help of world-class labs to test our products, we are confident that JustCBD™ is made with industry-leading quality, honesty, and love.”

These statements are allegedly “false and misleading” since independent lab testing reportedly confirmed that the company’s products contain significantly less than advertised. Gaddis’ CBD oil class action lawsuit included claims of breach of express warranty, breach of implied warranty, unjust enrichment, fraud, and violation of New York and Florida consumer protection laws.

The CBD oil class action lawsuit seeks statutory damages, compensatory damages, punitive damages, restitution, disgorgement, injunctive relief, court costs, and attorneys’ fees.

The CBD Hemp Oil Class Action Lawsuit is Gaddis v. Just Brands USA Inc., et al., Case No. 0:19-cv-62067-RS, in the U.S. District Court for the Southern District of Florida.
