Because the CBD industry is largely unregulated, there is no guarantee of how much CBD a product contains – if it contains any at all.

What is CBD

CannaBiDiol is a biochemical known as a phytocannabinoid, of which well over 100 have been identified. This group also includes tetrahydrocannabinol (THC), the psychoactive component in marijuana, and cannabinol (CBN), which exists only in trace amounts in the cannabis plant.

CBD is not psychoactive like THC; it does not produce a “high.” Although there is little in the way of solid, documented research into CBD, anecdotal evidence indicates that it is effective in treating a number of neurological disorders, including epilepsy.

Do CBD Oils Have Side Effects?

Safety studies indicate that CBD is well tolerated. Some people who take CBD report experiencing fatigue, diarrhea or changes in their appetite.

The Epidiolex product label warns that some patients may experience insomnia and sleep disorders as well. There is little information about possible drug interactions, though it may interfere with the metabolism of clobazam (Onfi), another prescription drug indicated for the control of seizures associated with Lennox-Gastaut Syndrome.

Which Single Product is Regulated?

Epidiolex is manufactured by GW Pharmaceuticals, which is based in the United Kingdom and remains the only CBD product available in the U.S. that has been approved for sale by the Food and Drug Administration. This is a certified medical marijuana-based prescription drug that has been successfully used to reduce seizures in patients suffering from forms of epilepsy associated with Lennox-Gastaut Syndrome or Dravet Syndrome.

Are CBD Companies Being Investigated?

CBD companies are not being investigated, at least not in any official, systematic way, although both the Federal Trade Commission (FTC) and the FDA have issued warning letters to manufacturers of CBD oils and edibles. These warnings involve unsubstantiated claims; some of them have claimed to treat serious diseases such as Alzheimer’s, cancer, and multiple sclerosis. Although CBD itself is relatively innocuous, Dr. Ned Sharples, acting FDA commissioner, told the media last summer, “Selling unapproved products with unsubstantiated therapeutic claims…can put patients and consumers at risk by leading them to put off important medical care.”

Have Any Purveyors of CBD Oils Been Sued?

A number of class action and individual lawsuits claim that CBD products fail to live up to their claims, particularly pertaining to the amount of actual CBD they contain. One of the most extreme examples was that of Just CBD Apple Rings Gummies, which the product label claimed contained 250 milligrams of CBD – but when tested, was found to contain virtually none.
