Irwin Naturals Supplements Class Action Lawsuit Overview:

  • Who: A New York consumer has lodged a class action against a California supplement maker, Irwin Naturals.
  • What: Irwin Naturals is accused of deceiving customers into believing its supplements are natural when they allegedly contain synthetic ingredients.
  • Where: The lawsuit is pending in New York federal court.

A leading California supplements producer, Irwin Naturals, claims its supplements are natural when they’re not, a new class action lawsuit alleges.

Plaintiff Joseph Asaro filed the class action lawsuit against Irwin Naturals in a New York federal court Monday, alleging misleading business practices.

Asaro’s claims are directed at the marketing and labeling of Irwin Naturals’ health supplements, including sleep aides, Gingko, belly-burners, immuno-shields and more.

“Defendant manufactures, sells, and distributes the Products using a marketing and advertising campaign centered around claims that appeal to health-conscious consumers, i.e., that its products are natural,” alleges the class action lawsuit.

“However, Defendant’s advertising and marketing campaign is false, deceptive, and misleading because the Products contain non-natural, synthetic ingredients.”

Irwin Naturals Contains Synthetic Ingredient

Asaro said the 23 named supplements contain multiple ingredients including Tocopheryl Acetate—which is allegedly a synthetic ingredient used in pesticide formulations—gelatin, soy lecithin and maltodextrin among many more.

“Defendant did not disclose that the above listed ingredients are synthetic ingredients,” the lawsuit states. “A reasonable consumer understands Defendant’s ‘Natural’ claims to mean that the Products are natural and do not contain synthetic ingredients.”

As a result of the deceit, customers paid too much for the product, the class action alleges.

The plaintiff is suing under New York General Business Law and for breach of warranty and unjust enrichment. Asaro is  seeking damages, fees, costs and a jury trial.

This is not the first class action lawsuit Irwin Naturals has faced. In 2020, another New York plaintiff accused Irwin Naturals of intentionally misleading the public about the power of Ginkgo Smart to improve a person’s brain function in order to sell more bottles and make more money.

The plaintiff is represented by Jason P. Sultzer, Joseph Lipari and Daniel Markowitz of The Sultzer Law Group.

I’ve been taking brain awake and I’m having auditory hallucinations just from taking only one (dose is 3) yesterday and one today. It’s really scary. I’d like to know if there’s anything I can do about this. I’m disabled (and broke), and have brain fog so I’m always looking for something to help me but hearing voices and being obsessive compulsive about pronouncing words correctly is bugging me out. I’m hearing shows I’ve watched and other people talking. I really liked this company, I used a different one for focus and can’t remember if I had adverse reactions. Thank you for the information. I’m also feeling more depressed and out of character. Help!

  2. Laura says:

I purchased Irwin Naturals 5-HTP Extra Mood and Relaxation. They give you 60 liquid soft gels and tell you there are 30 servings per container . Directions for daily consumption is 2 soft gels twice daily. This equals 4 tabs daily. That gives you 15 days of this supplement. This is very deceiving. CVS charges $23.99 for the bottle. Does that mean I have to spend $48 a month. I have started a claim with the FDA in regards to this matter. Bottom line is we are being deceived.

While looking for other information, I stumbled upon this lawsuit. I purchase Irwin Naturals products constantly, and I’m shocked I’ve never heard about this class action suit until now. I would like to look know more and find out if I’m eligible to recover damages or if it’s too late. I probably have 10 Irwin Naturals supplements of all kinds in my cupboard right now.

  4. Virginia Penn-Benson, Ph.D. says:

Started using Irwin Naturals years ago because I believed all ingredients to be natural. Several months ago began to have moderate to severe digestive symptoms which, through a process of elimination, I determined my symptoms were caused by Irwin Naturals 3-in-1 Carb-Blocker.

I purchased prosta strong on November 6th and took the recommended dose of 4 capsules. That night when I went to use the restroom I fainted bruising my knee. My son said that when he picked me up that I was grey. Since that night I’ve had horrible adverse reactions to their product. Including dizziness, vomiting, chills, and a overall horrible uneasiness. I have always been in good general health and I am sure that these effects were do to their product. I did some additional research on this company and found that there wasn’t any information on where they source their ingredients. I believe that I was poisoned by this product.
