FloSports subscription class action lawsuit overview:

FloSports misleads its customers into believing they are only being charged a monthly fee when they first sign up for a subscription with the sports broadcaster and streaming service, a new class action lawsuit alleges.
Plaintiff Jerry Hill claims FloSports customers are, in reality, charged an annual fee at the time of their initial check-out that is “exponentially higher” than the monthly fee.
Hill argues FloSports is also able to “unilaterally charge its customers’ renewal fees without their consent, as Defendant is in possession of its customers’ billing information.”
“Defendant has concocted a scheme to charge Plaintiff and other similarly situated customers on a yearly basis, absent their consent under the (Automatic Renewal Law),” the FloSports class action states.
Hill wants to represent a nationwide class and New York class of FloSports customers who were automatically enrolled and charged for at least one month of FloSports membership.
FloSports accused of having ‘incomplete disclosures’ on its checkout pages
FloSports has “misleading, missing and incomplete disclosures” on its checkout pages and in its acknowledgment emails sent to customers who have unknowingly paid for an annual subscription, the FloSports class action alleges.
Hill argues further that he was ignored by FloSports when he tried to contact the company within 30 days of purchase to contest the $160 annual charge.
“Defendant failed to acknowledge that Mr. Hill had contacted FloSports within 30-days of purchase and made the request to change subscription to monthly and refund the annual charge,” the FloSports class action says.
Hill claims FloSports is guilty of unjust enrichment, negligent misrepresentation and conversion, and is in violation of New York General Business Law and the Electronic Funds Transfer Act.
Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of compensatory and punitive damages for himself and all class members.
A similar class action lawsuit was filed against the National Football League (NFL) last month by a consumer arguing the NFL auto-converted and auto-renewed its NFL GamePass subscribers to its NFL+ service.
