Bradford Exchange agreed to pay $475,000 to resolve claims that it enrolled consumers in automatically renewing subscriptions without their consent. 

The settlement benefits a statewide class of Californians who were enrolled in either a Bradford Exchange or Hammacher Schlemmer rewards program and who were charged at least one membership fee for these programs. Employees of Bradford and Hammacher are excluded from this settlement.

Bradford Exchange and Hammacher Schlemmer are personalized gift companies. According to a class action lawsuit against the companies, the gift retailers violate California law by enrolling consumers in automatically renewing subscriptions without their consent.

Plaintiffs in the case say they were misled into enrolling in the retailers’ rewards programs. Both websites allegedly use pop-up windows promising free shipping to consumers who sign up for their rewards programs. Consumers like the plaintiffs are then locked into an automatically renewing subscription that charges them $14.95 each month, the class action lawsuit contends.

According to the auto-renewal class action lawsuit, Bradford Exchange and Hammacher Schlemmer violated California’s Automatic Renewal Law by enrolling consumers in their subscription-based rewards programs without consent. The law requires businesses to clearly and conspicuously disclose the terms of their automatic renewal subscriptions before enrolling consumers. California lawmakers passed this law in order to ensure that consumers didn’t have to dig through the fine print to realize what they were signing up for.

However, Bradford and Hammacher allegedly failed to comply with these requirements.

Bradford Exchange and Hammacher Schlemmer haven’t admitted any wrongdoing but agreed to a $475,000 class action settlement to resolve these allegations.

The settlement provides cash payments to consumers who submit a valid claim form.

Each class member will receive an equal share of the net settlement fund. Payments will vary depending on the number of participating class members and the amount deducted for attorneys’ fees and other costs. Any funds remaining in the settlement from uncashed checks will be donated to a cy pres recipient approved by the court.

The settlement also includes injunctive relief to benefit class members. The defendants have agreed to comply with all requirements of California’s Automatic Renewal Law. However, the companies maintain they never violated this law, as alleged in the automatic renewal class action lawsuit. 

The deadline for exclusion and objection is Dec. 30, 2022. 

The final approval hearing for the Bradford Exchange lawsuit settlement is scheduled for April 7, 2023.

In order to receive settlement benefits, class members must submit a valid claim form by Dec. 30, 2022.

    I have records if multiple deposits from the Bradford exchange into my account. This case states only California residents apply, but I live in Nevada.

    I am SO GLAD that I found your site! I had heard about the Equifax breach and I felt like I could have been affected. Then in 2020, I found out from a credit repair group that my Social Security number was found moving around the dark web I was shocked. I was being denied credit and employment opportunities. But I had resigned myself as an unlucky s o b with no recourse because I’m just a little guy. Then last week I found your site, got the facts about the settlement and finally found out that I AM part of the class. If I can only receive identity theft recovery it will be worth it. Down to today, it takes days for banks or other financial institutions to verify who I am. Most just deny my requests or applications due to their ‘inability’ to properly verify me, even with my giving them multiple layers of data/information that only the real George Mason would have or know. At any rate, you people are a Godsend! Thanks so much!
