Polaris RZR defect class action lawsuit overview:ย

  • Who: John H. Lindstrom filed a class action lawsuit against Polaris Inc.ย
  • Why: Lindstrom claims Polaris manufactured and sold certain model year 2021-2024 RZR 200 vehicles containing a defect that renders them inoperable and that currently allegedly cannot be fixed.ย
  • Where: The class action lawsuit was filed in Montana federal court.ย

Polaris manufactured and sold certain model year 2021-2024 RZR 200 vehicles, marketed for children, that are inoperable due to a defect that can cause them to lose steering-wheel control during operation, posing a crash hazard, a new class action lawsuit alleges.ย

Plaintiff John H. Lindstrom claims Polaris emailed him in September telling him to stop using the recalled RZR 200 vehicle, which he purchased for his grandchildren due to it being โ€œspecifically designed and marketed for use by children.โ€ย

Lindstrom argues he has been injured by the allegedly defective nature of the Polaris RZR 200 vehicles since his grandchildren are no longer able to use the vehicle and no fix is allegedly on the horizon.

โ€œEmployees at the dealership where he purchased the RZR 200 told him it may take six to twelve months for the fix to the problem with his vehicle,โ€ the Polaris class action states.ย

Lindstrom wants to represent a nationwide and Montana class of consumers who purchased a Polaris RZR 200 vehicle that was subject to Polarisโ€™ Safety Recall Z-23-06.ย

Polaris informs consumer there is no current fix for alleged RZR 200 defect, says class action

Lindstrom argues that, despite receiving an email notice from Polaris, he was unable to find the safety recall notice on the companyโ€™s customer recall site and that, after allegedly reaching out four times, he was told there was no fix.ย

โ€œTo date, there is still no fix to the problems with Lindstromโ€™s RZR and other similar RZRs,โ€ the Polaris class action states.ย

Lindstrom claims Polaris is guilty of negligent misrepresentation, unjust enrichment, breach of contract, and breach of express warranty and of violating the Magnuson-Moss Warranty Act and the Montana Consumer Protection Act.

The plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of actual and statutory damages for himself and all class members.ย

Polaris has issued a number of different recalls in recent months, including over a pair of fuel leaks, an improperly welded seat belt bracket, dangerous handlebar hooks and a throttle and brake issue.ย

I bought a RZR 200 EFi for my grandchildren for Christmas 2022. They have only driven it a handful of times due to the stop order.

  4. Katelynn Bishop says:

We bought a 200 with only 27 miles and used it 3-4 times. The dealership has had it for months and keeps pushing back the estimated pick up date. I was told by Addy Polaris the company is only offering an โ€œextended 6 month warrantyโ€ and $250 voucher. Unacceptable!

  5. Jason says:

We have two 200 EFIs unused since September 2023. From Washington state

I also have a Polaris 200 for my children that have not been able to use since September

  7. Layn Minyard says:

We bought our daughters a RZR 200 (part of the ride stop recall) almost one month prior to the notice. They got to ride it twice. They havenโ€™t been able to ride, since. Fortunately, they were uninjured due to this, as some of your children have. Iโ€™m very sorry to hear that.

  8. Ilima Ballinger says:

We have a rzr 200 that this part has broke on my son. Causing him to crash into a tree. This defect has definitely put a damper on his ride time.

  9. Justin Mellen says:

I own a RZR 200 that experienced the steering failure before the notice was sent out. It caused my daughters to roll and crash their rzr into a tree. It ha been parked since I received the notice. There have been no attempts by Polaris to contact me to repair damages caused or the issue.

  10. Amer Salhi says:

I have one as well parked and wont let me son play on it til Polaris come up with a solution :( I paid cash for mine :(
