McDonald’s mobile app class action lawsuit overview:

  • Who: George Keritsis filed a class action lawsuit against McDonald’s Corp. 
  • Why: Keritsis claims McDonald’s customers who place orders on the restaurant’s mobile app can be charged twice due to an alleged glitch in the app’s design. 
  • Where: The class action lawsuit was filed in Illinois circuit court. 

Customers who use the McDonald’s mobile app to place an order may end up being charged twice due to a glitch in the design of the app, a new class action lawsuit alleges. 

Plaintiff George Keritsis claims the McDonald’s mobile app does not always communicate to a physical restaurant location that an order has been placed, forcing a customer to pay for their orders twice. 

Keritsis argues further that the McDonald’s app can mislead users by telling them it will apply discounts — referred to as “Deals” — to their orders once they are completed, without actually doing so. 

“Customers, including Plaintiff, have experienced a full-price payment charge because the discount is not always applied as promised and advertised,” the McDonald’s class action lawsuit states. 

Keritsis wants to represent a nationwide class and a Florida subclass of McDonald’s customers who were improperly charged twice on account of the glitch, received “erroneous” auto-ordering confirmations or did not receive the discount promised by the app’s “Deal” feature. 

McDonald’s accused of double-charging customers in store

The alleged glitch can occur when a customer places an order through the McDonald’s app’s Mobile Order & Pay feature, which, in the event of a glitch, fails to both charge the user nor inform them that it hasn’t, according to the McDonald’s class action lawsuit. 

Keritsis argues that, when a customer goes to collect their order in the physical store location, McDonald’s will have them pay again, at which point they will be charged on the in-store point-of-sale system as well as on the app. 

“The physical McDonald’s stores claim to know nothing about the charges made by the App beyond whether payment was accepted or denied by the App,” the McDonald’s class action lawsuit says. 

Keritsis claims McDonald’s is guilty of negligence and unjust enrichment, among other things, and is in violation of the Florida Deceptive and Unfair Trade Practices Act, the Illinois Consumer Fraud and Deceptive Business Practices Act and the Illinois Uniform Deceptive Trade Practices Act

Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with compensatory damages and restitution for himself and all class members. 

McDonald’s asked a federal court earlier this month to dismiss claims that it uses per- and polyfluoroalkyl substances (PFAS) in its grease-resistant packaging, arguing that the PFAS it uses are safe and approved by the FDA

    I’ve been charged twice multiple times using McDonald’s App, it’s not that much money but it’s about the principle.

    Had the same thing happen to me in April where I was charged twice for an order, called customer service and was given the run around and offered a free sandwich, finally they agreed to refund me, waited over a month never received a refund so I called back they assured me they will refund and now it’s almost July, it’s sick that a multi billion dollar company won’t give me back $12 for an order I was charged twice for

    My girlfriend, and I have both been charged twice… on separate occasions. The restaurant will say: “ it’s an app issue, and there isn’t anything we can do about it. Email customer support, from the app.”

    We email support, and they give us some bs automated response…. “The charges are probably just pending, talk to your bank about the issue.”

    My was charged close to 100 dollars after using the McDonald’s app. We have deleted our profiles and deleted the app. I will be writing corporate to make a formal complaint about their app.

    My father in law in Ohio has had frequent double charges where he has ordered and paid in the app, the store doesn’t get the order and he has to order and pay again to get his food.
    My issue is with the deals, you give the code presented and meet the deal qualifications and then are told after the order is placed the the deal isn’t valid. The deal is then locked out for 15 minutes, or some are limited to 1X per day and the app says it is already used. This is a form of bait and switch. The manager refuses to honor the deal as well.

    Add me to that lawsuits. I have been charged twice several times with no refund that is fraud. Plus yes the you open the app and an old order pops up and you get charged again with no refund and no items. I have a big family so bring charged twice it’s in large amounts. This literally just happened to me again tonight. It’s not right….

    I was supposed to be charged $14.22. I hit submit. I then got a credit card notice that I had just spent $28.97. I called to try to cancel the order but they would not let me, nor have I been able to get a refund because McDonald’s says that this is doordash’s fault and doordash says I have to get a refund from McDonald’s. I ordered through the McDonald’s app but I paid doordash!

    Is this still open? I just discovered that McDonald’s app charged me anytime I opened the app. And this has been ongoing for months.

    If you have a problem with an app for restaurants one time and get no support from the restaurant or corporation, there’s no excuse for using that app again.
    Apps have turned everyone lazy.
    Seriously, if you’re going to drive there and wait in line to get your cheeseburger anyway, why bother using an app that ripped you off the first time?
    I believe this lawsuit is frivolous and although I am no friend of McDonald’s, I will support them rather than the crowd of fools saying, “I get double charged EVERY TIME I USE THE APP, which I use ALL THE TIME”.

    I’ve been charged twice because of the app but I don’t care about the lawsuit. If I was charged twice for something over $100, maybe.
    My solution: I uninstalled the app and contacted Mcdonald’s Corp directly to let them know why I’m never visiting their establishments again.
    I received a bribe in the form of $500 in gift certificates. I took a picture of the book, torn to pieces, in the trash and sent it to them.
    After your lawsuit is settled (a big maybe), you might get enough to buy a cheeseburger after everything is settled. Lawyer fees, other fees, losing time from work and having to split the settlement with the thousands of people who are going to jump on the bandwagon.
