Plaintiff Loriann Staples filed a class action lawsuit against Simmons Bedding Co. LLC, claiming the company’s 1,000 thread count Beautyrest products including bedding and linen actually have a thread count of 216.
The plaintiff claims she and others read the bedding packaging and purchased the bedding based on the thread-count claims, which the lawsuit says are not true.
Thread count is calculated by counting the number of threads in both the warp and filling directions and counting plied yarns as one yarn. But Simmons instead chose to count the plied yarns individually, which raises the count artificially and deceives consumers, the lawsuit claims.
That form of counting creates confusion and causes consumers harm, the Federal Trade Commission was quoted as saying, which can lead consumers to be misled,
“Despite knowing the long-standing industry standards, Defendant deviated from the traditional thread counting standards to mislead consumers,” the lawsuit says. “Defendant’s Beautyrest Products were manufactured, marketed, advertised, sold, and/or distributed with inflated thread counts.”
Simmons did not respond to or act on a pre-suit notice regarding implied and express warranties, lawsuit says
Simmons did not reply to or act on a pre-suit notice sent April 7 by the plaintiff related to the Beautyrest products.
Several mattress companies faced antitrust violation claims in 2020 after they were accused of making false and defamatory claims to government agencies in an attempt to restrain and monopolize the industry.

We had purchased 6 different beautyrest sets from At Home, thinking this was a good price for 1000 thread count sheets. We purchased 2 King, 2 Queen, 1 Full and 1 Twin. We no longer have the twin size mattress, does beautyrest make a single size sheet set with at least a 700 tc.

Does this lawsuit pertain to Simmons beauty rest mattresses? If so, please add me, I have purchased 2 in the last 2 years and already had to have one replaced due to mechanical failure. These mattresses are inferior products and quite pricey.
I need to file a Class Action Lawsuit against a company that charges a monthly, bi-yearly, and yearly fee for information, however, their database has not been updated since 2019, and the majority of the searches come back EMPTY. However, everyone is still charged for each search.
