  • Who: Plaintiffs Roger Barr, Elisa Montes de Oca and Gabriela Fernandez have a proposed settlement of a class action lawsuit against SelectBlinds LLC.ย 
  • Why: SelectBlinds agreed to pay a $10 million settlement on claims that the company showed fake regular prices on its website in comparison to the sale prices customers received.
  • Where: The SelectBlinds settlement was reached in federal court in California.

SelectBlinds has agreed to pay a $10 million class action settlement with plaintiffs Roger Barr, Elisa Montes de Oca and Gabriela Fernandez and a class based on claims that the company sells its products online next to fake regular prices.

U.S. District Judge Sherilyn Peace Garnett will hear an unopposed motion to preliminarily approve the settlement and certify the class on Oct. 25.

SelectBlinds was accused of posting regular prices on its website and then advertising sale prices next to it that the company claimed was available for a limited time, the SelectBlinds class action claimed.

Customers always received at least 30% off the regular price, the lawsuit claimed.

โ€œDefendant never actually sells its products at the listed regular prices, and consumers are not getting the advertised discounts,โ€ the SelectBlinds settlement says. โ€œIn short, Plaintiffs allege that โ€˜[b]y listing fake regular prices and fake discounts, Defendant misleads consumers into believing that they are getting a good deal.โ€™ โ€

SelectBlinds settlement will be paid in 12% cash refunds if a claim is submitted or 12% store credits for customers, filing says

The proposed SelectBlinds settlement class would receive $8.5 million in direct benefit with $1.5 million going to administration costs, incentive awards and attorneysโ€™ fees. The named class representatives will receive $2,500 service awards.

The awards would come in the form of a 12% cash refund for California customers who file a claim or a 12% SelectBlinds store credit that does not expire for those who do not file a claim.

Another window covering company, The Shade Store LLC, is facing a class action lawsuit claiming it offers window-covering products and accessories at fake sale pricing, in violation of California law.

    They are still practicing the same tactic after law suite settlement, e.g. advertise deep discount with inflated regular price that they never sold products at. The minor difference is that the count down timer is not there anymore. Does the inflated price not considered as deceptive? Or does removing the count down timer magically make inflated price not deceptive anymore?

    So people won millions of dollars when their damage was actually (probably) less than a grand?
    Wow!!! I received a $32.00 store credit. Hmmmmโ€ฆโ€ฆ letโ€™s seeโ€ฆโ€ฆ $32 store credit or sue for Millions? Decisions, decisions.
