Reynolds foil class action lawsuit overview:

  • Who: Zulaika Mayfield filed a class action lawsuit against Reynolds Consumer Products LLC.
  • Why: Mayfield claims Reynolds falsely advertises that its Reynold Wrap brand aluminum foil is made in the U.S., despite containing a raw material that is allegedly sourced from outside the country.
  • Where: The class action lawsuit was filed in California federal court.

Reynolds falsely advertises that its Reynolds Wrap brand of aluminum foil is made in the U.S., a new class action lawsuit alleges.

Plaintiff Zulaika Mayfield claims Reynolds Wrap aluminum foil is, in reality, uses a raw material called bauxite that is sourced from outside the U.S.

Mayfield argues Reynolds is thus misleading consumers who “value buying products which are made in America” by labeling that the Reynolds Wrap aluminum foil product is “Made in U.S.A.”

“Due to Defendant’s representation ‘FOIL MADE IN U.S.A. * * *,’ consumers will expect that all raw materials used in the foil Product are sourced from within the United States,” the Reynolds class action states.

Mayfield wants to represent a nationwide class of consumers who have purchased Reynolds Wrap aluminum foil since the beginning of the applicable liability period.

Reynolds Wrap aluminum foil contains bauxite that could not have been sourced in U.S., class action says

Since 1981, none of the bauxite that is mined in the U.S. is used for aluminum, with the largest suppliers of raw material coming from countries such as Australia, Guinea, Vietnam, Jamaica, India and Brazil, according to the Reynolds class action.

“Without bauxite sourced from outside the United States, it would be impossible to produce the foil Product,” the Reynolds class action states.

Mayfield claims Reynolds is guilty of unjust enrichment and of violating California’s Consumers Legal Remedies Act, False Advertising Law and Unfair Competition Law

The plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of punitive, exemplary, and compensatory, incidental or consequential damages for herself and all class members.

A federal judge in New York previously issued an approval in June 2022 for a settlement agreement between Reynolds and Southwire Co. and JP Morgan and Goldman Sachs that resolved claims the financial institutions colluded with metal warehouses to fix the price of aluminum.
