Louisiana homeowners who filed a class action lawsuit against home builder D.R. Horton alleging their homes were built with defective design and construction are now looking to represent hundreds more consumers.
According to documents filed Dec. 7 in the Louisiana 19th Judicial District Court in Baton Rouge, the Louisiana family that hit D.R. Horton with a class action lawsuit is now seeking to represent hundreds more homeowners across the state, The Advocate reports.
The couple, Alicia and West Dixon, have amended their lawsuit to expand the putative class to a group of as many as 1,000 plaintiffs.
If approved, the Dixons would be suing on behalf of themselves and “all other individuals similarly situated” who bought a D.R. Horton-built home after Jan. 1, 2007.
D.R. Horton lawsuit alleges company employed deceptive sales techniques
The Dixons first filed their lawsuit in March, alleging the Lafayette Parish house they purchased from D.R. Horton in 2014 wasn’t built to stand up to Louisiana’s heat.
They said their home ended up with mold, humidity and HVAC issues. One of the subcontractors that helped D.R. Horton built the house, Bell Mechanical Services, is also named as a defendant in the lawsuit.
According to court filings, the couple alleges it is among thousands of homeowners across the country who have bought defective D.R. Horton homes due to deceptive sales tactics.
The amended complaint alleges hundreds of Louisiana residents’ homes were built with “defective design and construction.”
“D.R. Horton is again trying to delay and conceal the truth about what it is telling prospective homeowners to try and sell houses,” plaintiffs’ lawyer Lance Unglesby said in a statement.
The company “has a history of failing to disclose material information to prospective buyers and using unethical sales tactics. Our clients have told us that D.R. Horton never warned them about humidity issues in their home designs, even after D.R. Horton received complaints.”
Meanwhile, the company has responded by arguing the case is under federal jurisdiction and has filed a motion to have it moved to federal court.
In 2021, homeowners in Baldwin County, Alabama, filed a class action lawsuit against D.R. Horton over claims the construction company did not build residences up to proper standards.

I bought a home in Houston TX in 2017 half of the neighborhood had to replace their roofs less than 7 years, siding is coming apart, floors are not leveled, sheet rock is not good, I had to replace my whole coil HVAC unit because there is no venting system in the attic area, the house smells molding and humid all the time. Roofing guy said I would have to get someone to place proper ventilation in the attic area or replace my whole roof soon.
Bought a DR HORTON home in MN IN 2023 and have had major design flaws, molding in areas near water, siding came off house in strong wind, blaming us for water leaking under windows, LVP in kitchen where water has spilt now there is bubbles where the floor soaked up the water and it is damaged, cracking on the ceiling
I purchased my home in TX 2024. DR HORTON did a scrappy job on my floors. I have made countless complaints about my flooring not being even, but they keep hiding behind “floating floors”.
I feel like I’m constantly walking up and down a hill in my home. They have bluntly told me there is nothing they can do as it’s not covered in my warranty.
My light got broken outside the house (still within 1 year) and i get told it’s not covered. I have to pay almost $300 for replacement.
I hear screeching noises on my upstairs floor/carpet and im told nothing can be done as it’s not part of warranty.
What really does my warranty cover and I was told to read what I signed.
Still within 1 year, I need my entire house caulked and again, it’s not covered.
They used really cheap quality for this home.
I also had a chip of the wall randomly and again, it doesn’t cover warranty
I purchased a new build in 2021. My AC went out in 2023. I had a company come out and was told that a used compressor was placed on my outside unit, $2600 dollars to fix. I also had water damage and when the removed a piece of the wall, and once they removed it, we found that the condensation pipe for the AC was cracked and improperly installed. Also in the crawl space underneath the hot water heater I found trash that the builders left behind. There’s no telling the issues that are going on with this house. The scary thing is when the problems do arise, they are costly and a hassle.
I purchased a DR Horton home in Slidell Louisiana. I purchased in August 2021. Are there any class action lawsuits I can join here? Thx

A COMPLETE NIGHTMARE
In April of 2010 I bought a DR Horton new construction home and I was told I wasn’t in a flood zone and the little over year having it I had a foot of water in my home and five more times within 7 years I had water in my home not to mention how many times we almost got water in the in the home and also having AC problems and other problems that I shouldn’t be having with a brand new home. I was a single mom with two kids and I never bought a home before this is a big first purchase for me and they pretty much took advantage telling me I don’t have to get my own inspector they had their own inspector to save me money different things like that which I was just so proud of myself and excited that I had a home for my kids and I listened and trusted.. very expensive, very disappointing lesson learned through all this and it’s just sad that they continue to build these homes and get over on people it’s not right..
I purchased a D.R. Horton home at the end of December 2022 and it’s been nothing but major problems ever since. I still haven’t unpacked all of my boxes- they’re still out in the garage- due to nonstop dealing with major electrical issues, HVAC issues, mold…I could keep going…this has been the worst excuse for a new construction home I’ve ever seen. Warranty tickets were put in back in February and I’m still waiting for repairs to happen. This is beyond ridiculous.
Also, when I’m in my attic (it’s a townhome), I CAN SEE INTO MY NEIGHBOR’S ATTIC. There’s a single wall of sheetrock between us, not two. So whose wall is it?! I showed the warranty department and they had nothing to say about it. Ugh.
I bought a new home in Texas 2019, have given up and just dealing with issues. DR Horton on our HOA board controlling things, they also have our MUDD dist taxing us to death controlling.
We purchased in Riverview, FL….a few QC issues but have submitted warranty requests
