DR Horton Home Construction Class Action Lawsuit Overview: 

  • Who: A class of homeowners in Baldwin County, Alabama, have filed a class action lawsuit against DR Horton Homes. 
  • Why: Homeowners claim DR Horton did not build residences up to code to withstand a Category 3 hurricane.
  • Where: The class action lawsuit was filed in Alabama.

Homeowners in Baldwin County, Alabama, have filed a class action lawsuit against DR Horton Homes over claims the construction company did not build residences up to proper standards. 

Homeowners claim DR Horton built houses between 2015 and 2021 that are at risk of not meeting so-called “Gold Fortified” standards that need to be met by insurers, NBC15 News reports.

A total of 88 homeowners are seeking damages that will allow them to fix their homes so that they are up to code, including new windows, roof gables and foundations. Homeowners allege their residences were not built on proper foundations and were made with poor materials. 

“Homeowners think they are safe, and they are not, and they are also getting a 55% discount on their insurance, and that 55% discount would probably go away,” David Sheller, who is representing the homeowners, told NBC15 News. “I don’t know what will happen when the insurance companies find out about this.” 

Company Misrepresented That Homes Were “Gold Fortified,” Counsel Says

Counsel for homeowners claim DR Horton misrepresented that the homes they built were “Gold Fortified,” which would make them able to withstand a Category 3 level hurricane, NBC15 News reports. 

DR Horton Contractors do not properly train their workers and hurry when doing the construction, the homeowners argue, NBC15 News reports. 

Homeowners claim DR Horton is in violation of the Alabama Deceptive Trade Practices Act, which would make the residents eligible for damages related to emotional distress, travel damages and attorney fees, they argue. 

Earlier this month, Castle & Cooke reached a $320,000 settlement deal with homeowners in Hawaii who claimed their residences were not properly built to withstand wind.

Homeowners in Laguna Beach, California, filed a class action lawsuit earlier this year against Amplify Energy Corporation and its subsidiary, Beta Operating Company LLC following an October oil spill that affected residences off the California coast.

    We purchased D.R. Horton home June 2023 submitted several repairs for warranty and have to stay on top of them left and right to get out here and fix this mess. We mentioned ceiling and cracks and they keep trying to say nothing wrong with ceiling when obviously it’s bowed and cracked at ceiling to walls, electrical outlets, fans. Like they just throw them together to get the funds and then sell your contract to other mortgage company after 2-3 months.

    I purchased a DR Horton home in Florida July 31, 2023 and have had nothing but problem after problem. Ceiling leaking, horrible paint job, holes in porch, debris left in driveway, garage door showing light, pest control and much more. Neighbors have complaints as well. The HOA has gone up 3 times in less than 2 months.

    Poor structural plumbing that has caused almost 80,000 in repairs/damages. Original property owner since 2015. Flooring has been replaced in 3 bathroom, kitchen, 2 dehumidifier, HVAC, humidifier, multiple sinusitis. Can an attorney please contact me.

    My husband and I purchased a Dr. Horton/Freedom home on Oct. 31, 2019. Issues with have had or are having….flooring, wiring, humidity, HVAC, infestiation….etc..
    Would love to speak with an attorney. Any help or direction will be greatly appreciated.

      Same issues with DR Horton in South Florida. Excessive humidity and mold. Others in neighborhood are experiencing the same in addition to roof leaks and cracks in foundation, walls and roofing.

        Hello, my name is Takisha, I live in Springville, Alabama, I have lived in my DH Horton home for almost 3 years. I have the same issues far as water in the ceiling, Electrical and faulty work.

      I have DR Horton home- sane issues- they had untrained construction workers that did not know what they were doing. I hired my own home inspection instead of the one they provided for everybody here. and he found a lot of issues that I’m still trying to get dr Horton to fix. the keep saying they’re going to look into my foundation issues and there is in no drainage in my yard. The culvert our yard is supposed to drain into is not within code it wasn’t in within building code back in 2018 when we bought it. Ive asked them to fix this right away- I’ve been emailing them- even when our house was under warranty they said there was nothing else they could do. All the grass we’ve bought two times has died water pools everywhere – we have allergies, fungus gnats infestation and mold algae. I have to spray ortho bug home defense every 2 to 3 days – I have small children and a daughter with an autoimmune disorder – my next door neighbour has the same issues- brain fog I mean I’m a mental mess living here . a stay at home mom with children who are also sick. it’s a nightmare and DR HORTON DIES NOT CARE! If we did get anything looked at they would only send us the least expensive person to do whatever it is Needed to be looked at the home while under warranty. they wouldn’t even prime the walls- we asked for the walls to be repainted because that’s a huge undertaking for a pregnant house wife whose husband is gone 20 days a month. DR Horton would not allow the painters to use primer, I have an offer to buy the primer . These are all just little issues and it sucks

    Any lawsuits in OK? We are willing to join a class action lawsuit if anyone is fighting the rights of the homeowners is OK whose houses were not built correctly by DRH and repairs only made worse by their contractors. Please reach out.

      I moved into my new home September 8, 2017. I have been dealing with so many issues. I have a very long list problems since I move in by the way they my home. Please contact me. I want to join in on the class action lawsuit.
