Bob’s Discount Furniture Misleading Insurance Class Action Overview:

  • Who: Bob’s Discount Furniture and Guardian Protection Products, Inc.
  • What: Bob’s Discount Furniture and Guardian are accused of marketing and selling an insurance product for furniture that doesn’t cover what it promises to cover.

Bob’s Discount Furniture sells insurance that promises to make your furniture ‘Goof Proof,’ then denies coverage on the most basic of goofs, a new class action lawsuit alleges.

Plaintiff Gina Argenbright filed the class action complaint against Bob’s Discount Furniture and Guardian Protection Products, Inc. Monday in an Illinois federal court, alleging violations of federal and state consumer laws.

She said the furniture retailer teams up with Guardian to offer insurance referred to as “Goof Proof Protection.” According to Argenbright, to “goof” can be to make a careless mistake, or a slip, or to “engage in playful activity.” In the realm of insurance coverage, she said Bob’s defines it as offering coverage for accidental damage.

However, when consumers go to claim for the most obvious of “goofs”—including goofs they had no part in—they are denied coverage, she claims. 

In Argenbright’s case, she says she purchased a queen bed from Bob’s in 2019, along with the Goof Proof coverage for $39.99. 

In November 2020, the wooden slats underneath the bed broke when she got in. She claimed for the alleged “goof” in December 2020, but Guardian denied her claim on the basis that the coverage only covers “accidental damage” and the incident was not accidental.

“It is false and deceptive for Bob’s to market an insurance product that promises to provide coverage for ‘goofs,’ yet also describe Goof Proof as coverage for accidents,” the class action states.

“Consumers understand the term ‘Goof Proof’ broadly to mean ‘mistake proof,’ i.e., if something goes wrong with furniture, they will be covered if they purchased Goof Proof. Guardian denies most claims based on ‘misuse.’ However, the definition of ‘Goof’ encompasses ‘misuse,’ even inadvertent misuse,” the lawsuit argues.

Argenbright adds that the salesperson conveyed to her that Goof Proof would cover “anything and everything,” when she asked about purchasing the coverage. 

She’s looking to represent any Illinois residents who purchased Goof Proof plans. She’s suing under Illinois Consumer Fraud and Deceptive Business Practices Act, for breach of contract and breach of warranty, fraud and unjust enrichment. 

Argenbright is seeking certification of the class action, an injunction, damages, costs, fees and a jury trial. 

This lawsuit follows a similar one filed by the same law firm last year in New York. In that case, Plaintiff Renal Glover said the Goof Proof warranty is marketed and sold to protect against furniture damage such as food and beverage stains, pen marks, tears, and punctures.

However, Bob’s Discount Furniture collects premiums and then rejects claims submitted under the warranty, he claims.

    I was told the switch on my electric recliner was excluded – but the motor wasnt – took 3 months to get them to send a tech out. I’m guessing if my motor was bad they woukld heve told me it was excluded but if it was the switch they woukld have covered it. I’m driving to my Bob’s dealer to confront them on this bullshit

    I bought my furniture from American Freight in 2021 with a protection plan that is essentially the same as the Bob’s GoofProof through Guardian. The sign in the store lists bulletpoints of what is covered and when you purchase you are not given specific terms – this is only provided when you buy the plan and then go register it on their website or they deny a claim – that fits all of the bulletpoints it was supposed to cover. They basically come back and say “Your plan does cover this…but…not that specifically”. They are a complete scam and I’d like to get another class action going for them!

    My dog was home a lone tore apart a section of a recliner, now tell its not cover. We were told that anything goes wrong it we be cover on my living room and bedroom furniture.

    Great deal on a sectional sofa but quality isn’t what was expected. The Insurance they offer is horrible and create loops holes to not fix any issues. One part of the frame detached, some of the cushions are filled equally so they are not holding its shape. Last but not least the bottom cushions are starting to tear. I sent pictures and explained everything. They made a bunch of excuses and said its is on me. Mind you I bought then in 2020, these issue’s should not be happening. Less than 3 years old and I paid all in cash including the insurance.

    Bob’s should be ashamed of their garbage Goof Proof. It is nothing but a money making scam. Lord help you if you need to get ahold of Guardian, who handles the claims once Bob’s has decided that whatever has happened to your furniture is not Bob’s problem. I have been calling 1-800-538-9500 for 10 days straight and they never answer, they promise to call you back if you select 1 and verify your number, but they never call back. Bob doesn’t stand behind his furniture and I implore people to steer clear of the store unless you are ok with spending hard earned money on furniture that doesn’t hold up to anything more than a feather being placed on it in three months time.

    Bought the insurance when i bought my l shaped couch they then told me that the tear that happened in my couch wasn’t covered. Guardian stated it wasn’t a accidental tear. I had the couch for about 5 months. Paid 300 for the insurance which now has a rip in the couch. Aweful customer service from Bobs Discount Furniture on this as well, they push you into buying the warranty but its not covered!!!

      I’d like to add to this as well. I spoke to Bobs Discount personally myself waiitng on management to call today. They finally after 4 plus months of complaints and saying they showed up at my home to repair my furniture then stated they had the wrong phone number to contact me, which i then said thats bullshit because i got the text confirming my appointment. I lost out on a days work in upwards of 300 a day depending for them to not show up. As of yesterday they are replacing my couch with a delivery date of 12/22. This goof proof warranty that i paid 299 for is absolute bull and the employees at their store continue to push it when it doesn’t cover anything. I felt very pressured and pushed into buying this, the way i was made to believe was that it covers anything that happens to the furniture in that time frame. I’d like someone from this attorney side to reach out to me via phone or email.

    Trying to settle my claims from a sectional that’s breaking down after two years, losing padding, pilling and looks like a 25 year old sectional! Goof proof warranty? All lies!! Getting no where with Guardian Protection! Just a run around! Please add my name to any class action law suit! We are all being scammed!

      4 month and my poor dog getting stuck in my couch between cushions where its separating from the frame of the couch, after a no show appointment to look at the furniture they are immeditley sending me a replacement. I just hope its not as crappily made as this one and my dog doesn’t get stuck in the 1 grand couch i bought and had for only 3 months for all this to happen.

    Worst company! They sell you a lie at the store, that this plan will cover accidently repairs. All lies! They deny claims and don’t respond. You cant reach anyone by phone, I’ve been on hold multiple times for hours waiting for rep. Never again will I buy from Bobs or Guardian. They need to be sued for their false advertisement.

      Hi I live California and bought a sectional and counter high dining set and I filed a claim on dining room bench because because I sat on it and got up and the wood where put feet broke into pieces and filed a claim it was denied. Called and asked why was it denied they said it was an accident. Thats bull
