Better Earth class action overview: 

  • Who: Plaintiff Mercedes Quesada filed a class action lawsuit against Better Earth Inc. 
  • Why: The class action accuses Better Earth of failing to install solar panels during the 90-day contract window and failing to install fully operable solar panels.
  • Where: The Better Earth solar panels class action was filed in federal court in Florida.

A class action lawsuit against Better Earth claims the company failed to install solar panels that are fully operable, and also didn’t complete the work during the 90-day timeframe in its installation contracts.

Installation of solar panels at the plaintiff Mercedes Quesada’s home took 209 days from the contract date and, even then, the Better Earth solar panels were not connected to the grid and generating energy.

Duke Energy customers must pay for an umbrella insurance policy to be connected to the grid, according to the Duke Energy Standard Interconnection Agreement cited in the lawsuit.

Better Earth had promised to pay the $1 million umbrella policy premium required for homes with panels between 10 kilowatts and 100 kilowatt hours. But that premium was never paid to the plaintiff or others and the Better Earth solar panels then are not fully connected to the grid, the lawsuit claims.

A second part of the Better Earth solar panel agreement was reimbursement for monthly loan payments for the system while also paying an electric bill. Those reimbursements happened for the lead plaintiff at a rate of $193.94 per month from November 2022 through April 2023. Then Better Earth paid $387.88 for May 2023 and June 2023 on June 6 before ending payments.

Better Earth connected the panels to the grid without telling Duke Energy in April 2023 and the plaintiff has not received credit for energy created on bills since then and a meter to measure that energy has not been installed because the umbrella policy payment was never made, the Duke Energy class action claims.

A class action lawsuit this spring alleged that Vision Solar preyed on vulnerable populations to sell a solar system that did not work as promised.
