Trident xylitol class action lawsuit overview: 

  • Who: Christie Quilez filed a class action lawsuit against Mondeléz Global LLC. 
  • Why: Quilez claims Mondeléz Global falsely represents that its Trident “Sugar Free Gum With Xylitol” contains xylitol as its primary sweetening ingredient.
  • Where: The class action lawsuit was filed in New York federal court.

Mondeléz Global LLC misrepresents its Trident brand “Sugar Free Gum With Xylitol” product since its predominant sweetener is actually sorbitol, a new class action lawsuit alleges. 

Plaintiff Christie Quilez claims the oral-health benefits of the Trident gum product are “practically extinguished” since it allegedly “lacks enough absolute and relative amounts of xylitol to deliver the oral health benefits this polyol is known for.” 

A polyol is a type of carbohydrate that is “distinct from sugars or alcohol” and that has “filled the void of sucrose-based sweeteners,” according to the Trident class action.

Quilez argues Mondeléz falsely promotes its use of xylitol in the Trident gum product to make consumers think xylitol is “highly valued” and that it is either predominantly used as its sweetener or has a “relatively significant amount.” 

In reality, the Trident Sugar Free Gum With Xylitol primarily contains sorbitol because it is less expensive with a higher profit margin than xylitol, which is more costly, the Trident class action alleges.

Quilez claims she purchased — and paid more for — the Trident gum because of her expectation that it would have enough xylitol to “provide the superior effects on oral health” it is known for. 

Numerous studies have concluded that xylitol is “the polyol of choice in sugar free chewing gum” for a variety of reasons, including that it allegedly causes a higher reduction in plaque than sorbitol,” according to the Trident xylitol class action. 

“When it comes to plaque, the sticky film that coats teeth and contains bacteria, chewing gum containing only xylitol was more effective than those with xylitol and sorbitol,” the Trident class action states. 

Quilez claims Mondeléz Global is guilty of unjust enrichment and fraud and of violating the Magnuson Moss Warranty Act, several state consumer fraud acts and New York General Business Law

She demands a jury trial and requests an award of monetary, statutory and/or punitive damages for herself and all class members. 

Quilez wants to represent a New York class and multistate consumer fraud class of individuals who purchased the Trident Sugar Free Gum With Xylitol product during the statutes of limitations for each cause of action. 

A consumer filed a separate class action lawsuit against Mondeléz Global in November 2022, arguing the company misled consumers into thinking its Trident brand “Original Flavor” chewing gum product contained real mint flavoring.
