Kraft Heinz Country Time Lemonade False Advertising Class Action Lawsuit:

  • Who: A lemonade drinker is suing Kraft Heinz Foods Company over its Country Time lemonade and pink lemonade powder drink mixes.
  • Why: The consumer says Kraft advertises that the packs make more lemonade than they really do.
  • Where: The class action lawsuit was filed in an Alabama federal court.

Kraft Heinz has left one customer thirsty by claiming there is enough powder in its Country Time packs to make eight quarts of lemonade when in fact it only makes six quarts, a new class action lawsuit alleges.

Plaintiff DeMarcus Rodgers filed the class action complaint against Kraft Heinz Foods Company Apr. 21 in an Alabama federal court, alleging violations of state and federal consumer laws. 

The complaint relates to Kraft Heinz’ alleged false labeling “and deceptive trade practices” of its 19 oz. canisters of Country Time lemonade and pink lemonade powder drink mixes.

The canisters of Country Time lemonade and pink lemonade powder drink mixes’ labels state that they make eight quarts of lemonade, Rodgers states. 

The canister lid is used as a measuring cup, with one line for measuring one quart, and another line for measuring two quarts. 

However, the canister, while purporting to make eight quarts of Country Time lemonade and pink lemonade, only contains enough powder drink mix to make six quarts of Country Time lemonade and pink lemonade, Rodgers states. 

Lemonade Canisters Make 6 Quarts, Not 8 As Advertised, Country Time Class Action Claims

Rodgers says, despite knowing that the canisters of Country Time lemonade and pink lemonade powder drink mixes do not contain enough powder drink mix to make eight quarts, Kraft Heinz has engaged in a widespread false advertising campaign to portray that they do.

Rodgers says he purchased the canisters on multiple occasions in Alabama. After some time, he began to notice that the lemonade and pink lemonade tasted diluted.

He says he then noticed that when measuring the powder drink mix, he was only able to measure six quarts worth of powder drink mix instead of the usual eight quarts worth of powder drink mix per canister.

Rodgers said he paid more for the product than he would have if he had known it only made six quarts.

Rodgers is looking to represent anyone in the United States who bought a 19 oz. canister of Country Time lemonade and/or pink lemonade powder drink mix plus an Alabama subclass.

He’s suing under for violations of the Magnuson-Moss Warranty Act, Breach of Express Warranty, Breach of Implied Warranty and violation of the Alabama Deceptive Trade Practices Act.

Rodgers is seeking certification of the class action lawsuit, fees, costs damages and a jury trial.

The news comes as Kraft Heinz faces another class action lawsuit for allegedly mislabeling its peach mango-flavored MiO product by advertising natural flavors and concealing its artificial flavoring.
