equifax credit report websiteAn Equifax class action settlement website has been established to help provide information to potential Class Members in the pending litigation.

The website will act as a landing page for Class Members who had a tax lien or civil judgement on their Equifax credit report between June 28, 2015 and May 14, 2019. These consumers have the option to participate in the Equifax class action settlement.

While the website is live, it is not accepting claims yet. Top Class Actions will provide claim filing instructions as soon as they become available.

The settlement resolves Fair Credit Reporting Act claims from at least 19 separate class action lawsuits across the country.

The settlement would resolve claims that Equifax inaccurately reports tax liens and civil judgments on consumer credit reports.

For some consumers, they will benefit from the settlement without having to file a claim. All Class Members will receive the benefit of Equifax ceasing to report civil judgements and tax liens for five years.

Participating in the settlement will not cause Class Members to release their individual claims, but they will not be able to file a future class action lawsuit regarding these issues.

Other consumers who have proof that they suffered from adverse actions due to Equifax reporting an inaccurate tax lien or civil judgement will be able to submit a claim for a payment of $1,500.

Accepting the payment will require consumers to sign a release of claims, meaning they cannot take further legal action against Equifax for this issue.

Plaintiffs and Class counsel state that the settlement is fair and reasonable. It reportedly provides an “extraordinary result” to the Class Members in a deal that is “significantly less burdensome than filing a court action.”

“Pursuant to the Settlement, the putative Class Members are guaranteed a substantial recovery with groundbreaking injunctive relief and access to a valuable ADR process that will pay them real money,” the plaintiffs said in the preliminary approval request for their Equifax class action settlement.

“The settlement is narrowly drawn to limit the release to only class action cases pertaining to Equifax’s failure to report correct and up-to-date public records due to a subsequent disposition. No individual claims for statutory, punitive, or actual damages are released and no other FCRA class claims are excluded.”

A deadline for claims is not currently available, but Class Members will have around 24 months to file a claim for payment after the effective date of the settlement.

In order to object to the settlement terms, Class Members need to submit their objections by Sept. 6, 2019. The final approval hearing for the settlement is scheduled for Sept. 13, 2019.
