Fujifilm cameras class action lawsuit overview:

  • Who: Jethro Inong filed a class action lawsuit against Fujifilm North America Corp.
  • Why: Inong claims Fujifilm falsely advertised that its X-Pro3 cameras were durable and capable of functioning for years, despite allegedly containing defective ribbon connector cables.
  • Where: The class action lawsuit was filed in New York federal court.

Fujifilm falsely advertises that its X-Pro3 cameras are “durable, capable of functioning reliably and remaining in proper working condition for years to come,” a new class action lawsuit alleges.

Plaintiff Jethro Inong claims the Fujifilm X-Pro3 cameras were manufactured with defective ribbon connector cables that cause the device’s viewfinder and/or LCD touchscreen to “glitch or stop working altogether.”

Inong argues “most consumers” encountered the alleged defect with the Fujifilm X-Pro3 cameras unexpectedly and without warning, and that “the defect was present and continuously evolving much sooner than noticed or experienced.”

“This is because the ribbon connector cable mechanism is too weak to withstand normal use, frequent opening-and-closing, and switching between view modes,” states the Fujifilm class action.

Inong argues cameras with non-defective ribbon connector cables are available on the market and are capable of “functioning reliably and remaining in proper working condition for years to come.”

Fujifilm accused of being able to sell X-Pro3 camera at ‘premium price’ due to alleged misrepresentations

Fujifilm, meanwhile, was able to sell its X-Pro3 cameras at a “premium price” — and higher than similar products — due to its allegedly false and misleading representations about the products durability, the Fujifilm class action alleges.

“Plaintiff chose between Defendant’s Product and products represented similarly, but which did not misrepresent their attributes, features, and/or components,” the Fujifilm class action says.

Inong wants to represent a California class and multistate consumer fraud class of individuals who have purchased a Fujifilm X-Pro3 camera within the statute of limitations.

Fujifilm is accused of unjust enrichment and of violating various state consumer fraud acts, the Magnuson Moss Warranty Act and New York General Business Law

Plaintiff is demanding a jury trial and requesting declaratory relief along with an award of monetary, statutory and punitive damages for himself and all class members.

A separate class action lawsuit was filed against Sony earlier this month by a consumer arguing the serial number stickers on some of its G-Master camera lenses fall off, preventing consumers from being able to get a free repair under a recent recall.

The Fujifilm cameras class action lawsuit is Inong, et al. v. Fujifilm North America Corp., Case No. 7:22-cv-09720, in the U.S. District Court for the Southern District of New York.
