The US Food and Drug Administration (FDA) has rejected 950,000 applications for flavored vaping products and removed 55,000 electronic cigarettes from the market, but is yet to decide on the fate of e-cigarette market leader Juul Labs.
The agency missed a court ordered deadline of September 9, when it was supposed to have decided which e-cigarette products could stay on the market and which needed to be pulled.
The deadline was set by a federal judge in his ruling in a lawsuit brought against the agency by public health groups. The groups wanted the FDA to speed up its approval process under the Tobacco Control Act, saying the majority of e-cigarette products were posing grave public health risks to youth. The FDA has said that 80 percent of e-cigarette users are aged 12 to 17.
The FDA said that it had reviewed the more than 6.5 million applications for vaping products since the deadline was ordered last year, had removed 55,000 flavored e-cigarette products due to risk to teens, and had shut down several small vaping shops.
However, it added there was still work to be done – such as deciding on the fate of the major market leaders including Juul Labs.
“There’s more work to be done to complete our remaining reviews and ensure that we continue taking appropriate action to protect our nation’s youth from the dangers of all tobacco products, including e-cigarettes, which remain the most commonly used tobacco product by youth in the United States,” the agency said in a statement.
The FDA said it was in the final stages of reviewing all outstanding applications.
Juul Labs Accused of Hooking Youth on Vapes
Juul Labs is only seeking approval for its Virginia tobacco and menthol flavored e-cigarettes, after it announced it was pulling all of its fruit flavors in stores in 2018, reports Law360.
Fruit flavors have largely been blamed by the FDA for the huge popularity e-cigarettes have with youth.
In a statement to Law360, Juul Labs said it was committed to transitioning adult smokes away from combustible cigarettes while combating underage use.
“We respect the central role of the FDA and the required through science- and evidence-based review of our applications, which is key to advancing harm reduction and earning a license to operate.”
Juul Labs is currently facing legal action over its e-cigarette products, after they were linked to the onset of seizures, which is a known side effect of nicotine toxicity, and lung injuries.
