7-Eleven JUUL Misrepresentation Class Action Lawsuit Overview: 

  • Who: Cristian Ali filed a class action lawsuit against 7-Eleven, Inc. 
  • Why: Ali claims 7-Eleven misrepresents JUUL E-Cigarettes it sells as safer or at least comparable to regular cigarettes.
  • Where: The class action lawsuit was filed in Florida federal court.

7-Eleven misleading markets and sells JUUL E-Cigarettes as a “safer or at least comparable” alternative to cigarettes, a new class action lawsuit alleges. 

Plaintiff Cristian Ali claims that, in reality, a single JUUL E-Cigarette contains the same amount of nicotine as an entire pack of cigarettes and in a more highly concentrated and addictive form. 

Ali claims that, because of the higher concentration of nicotine they contain, the JUUL E-Cigarettes are actually more addictive than regular cigarettes. 

Further, Ali argues 7-Eleven fails to warn consumers that the JUUL E-Cigarette products are “far more potent and addictive than conventional cigarettes.”

“Despite Defendant’s actual knowledge of the extremely high nicotine content and wealth of information elucidating the inordinate hazards of the Products, Defendant failed to warn that the Products it markets and sells are far more potent and addictive than tobacco cigarettes,” the class action lawsuit states.

Plaintiff ‘Denied The Benefit’ Of His Bargain Over Omissions

Ali claims he was “denied the benefit” of his bargain since he only learned after the fact that the JUUL E-Cigarettes he purchased were not in fact a safer or comparable alternative cigarettes.

“Plaintiff has purchased Products that are unreasonably harmful and addictive and not as represented by Defendant,” the class action lawsuit states. 

The nicotine content in the JUUL E-Cigarette products is more concentrated since they contain protonated nicotine, which allows users to “absorb higher concentrations” than if they were ingesting free-base nicotine, according to the class action lawsuit. 

Ali claims the protonated nicotine is also less harsh than free-base nicotine, which allows previous non-smokers a greater ease of smoking the devices and makes the products even more addictive. 

Ali claims 7-Eleven is guilty of negligent misrepresentation and unjust enrichment, among other things, and is in violation of the Magnuson-Moss Warranty Act and Florida’s Deceptive and Unfair Trade Practices Act

Ali wants to represent a Florida Class of consumers who purchased JUUL E-Cigarettes from a 7-Eleven in the state in the past four years. 

Plaintiff is demanding a jury trial and requesting declaratory relief and actual damages for himself and all class members.

In October, Juul and the Altria Group agreed to pay $90 million to resolve claims they misled investors about their marketing strategies targeting youth
