dodge ram engine class actionA California man filed a proposed class action lawsuit against FCA (formerly Chrysler Group) claiming the automaker’s Dodge Ram engines have an inherent defect, making it impossible for the trucks to pass required smog inspections.

Plaintiff Ricardo Castro brought forth the FCA smog defect class action alleging breach of warranty, fraud by omission, and unfair competition, specifically claiming that FCA was aware the vehicles engines would not meet smog requirements or comply with California emissions laws yet concealed this information from the consumer public.

“Notwithstanding this knowledge, FCA has sold and leased the class vehicles, and has failed to revise a remedy which would result in the class vehicles being in compliance with California emissions law,” Castro’s attorneys stated. “Furthermore, FCA has concealed from the public and from class members that the class vehicles are not smog compliant.”

As a result of the alleged engine defect, Castro has been unable to have his vehicle pass California emissions testing and has suffered a financial loss. He claims that while still under warranty, his vehicle did not pass a required smog inspection and he subsequently took the truck to an authorized FCA repair facility to remedy the situation in order to have the truck pass the smog test.

The FCA authorized repair facility performed repairs but was unable to fix the alleged smog defect, advising Castro that he would need to drive the Dodge Ram truck more than 100 miles after repairs were done to resolve the emissions problem. To date, Castro’s truck has been unable to pass a smog check.

According to the complaint, the “FCA has been advised of the emissions defect, and of the resulting harm to class members; however, FCA has failed to unconditionally reimburse Castro or other class members for the damages that have resulted from the emissions defect, and has failed to resolve the emissions defect.”

As a result of the FCA’s alleged misconduct, Castro is seeking certification of California Class of owners and lessees of 2013 Dodge trucks with the defective engine and unspecified damages in excess of $5 million. The proposed Class is also seeking a declaration the FCA is financially responsible for notifying all Class Members about the defective nature of the vehicles and an order enjoining FCA from further deceptive practices.

This is not the first time the FCA has been under fire for deceptively concealing information on its vehicle’s systems. A class action lawsuit was filed earlier in Illinois over allegations that its Fiat cars’ Uconnect infotainment systems are vulnerable to hacking.

    2014 ram 1500 laramie cam lifter failure at 100,000 mi. $4500 ouch.

    My 2011 1500 5.7hemi started to tick many months ago, at about 80k miles. Dealer said they ALL do that. It’s normal they said.
    Recently, misfire cyl 3, so I took it back. Cam worn by lifter due to lack of oiling correctly.
    They wanted to replace the engine, because “that’s what they’re supposed to do” & “it’s a common problem “.
    They’re estimate was approx $13,600. Parts and labor.
    Oh, hell no!
    I’m pissed. I used to use this truck daily for normal transportation and do regular deliveries with it too.
    Loss of vehicle and income.
    I want to sue them, for sure.
    Count me in !

    I have RAM Dodge 2018, I have never heard uconnect until I bought this truck… If I knew about uconnect, I would not have bought this truck. The radio changes on his own cannot use any of the setting, no App button stay still for you to change or press, changes on his it’s own, the screen gets so hot I’m afraid to drive my truck most of the time with my kids… This is the worst system!!!!
    I don’t mind Dodge ram I just don’t like the system they chose to go with its scary between thinking you’re going to explode because The screen gets so hot, the radio playing on his own screen change it on his own… The worst system they can ever go with… My truck has 52,000 miles on it, unfortunately I’m 2000 away from the manufacture warranty to where it is out of pocket for me now. But they should’ve done is have a better system !!! I have Hyundai Genesis 2010 I never had a problem with a single system off of it.. I should’ve stuck with the Genesis with the Hyundai company !!!

    Have a 2011 ram 1500 with 87000. Check engine light came on and started flashing. Checked with computer and said mid fire cylinder 2, so I changed all coil packs and spark plugs went and ran down the road a few miles and light cam on again. Machanic is saying cam shaft and lifter?

    2015 ram 2500 6.4 hemi. Replaced transmission at 73k miles $6500 Now at 76k and cam and lifters (or engine) replacement required.

    I had lifter no. 5 go bad and ruined the camshaft at 76,000 miles. CHRYSLER DOES BAD BUSSINESS.

    I bought a 2012 ram 1500 with the 5.7 hemi had 86000 miles on it. 1 month after I bought it I started hearing a tick in the engine. The tick got worse and turned into a cylinder #5 misfire. I did research online to find out the lifters fail and eat into the cam. Took it to a shop to find out the exhaust valve wasn’t opening. They took out the lifters and found cylinder 5 exhaust roller lifter failed and ruined the cam. Spent $4000 to replace the cam and lifters. 2 weeks later the transmission got stuck in 4rth gear. Had to replace the transmission solenoid pack. After that I sold the truck.

    I have the same issue with our dodge ram 2500 SLT the engine thick, involving the lock of lubrication on the camshaft, is over $ 5,000 to rebuilt the engine or replace it.

    I will like to be part of the lawsuit if ever comes up

    FCA needs to take care of these issues. I have a 2013 dodge ram1500 hemi. Well I’ve been doing some research and come to find out A LOT of people are having the same issues with the “hemi tick” which are caused by bad lifters, yet chrysler refuses to recall the issue. I’m still making payments on my truck and even lost equity in it. I can’t find a lawyer who will help because my truck is now past the warranty.

    Have a 14 Ram and just started the tick and random misfire on cyl #2. Would love to get in the class action suit.

      I have a 2010 Ram with the 5.7l just had to replace the camshaft and lifters. Cylinder 3 was misfiring and wore the lobe flat. Mechanic said parts were on backorder 3-4 months nation wide because it is such a common issue with the 5.7
