Rideshare drivers file lawsuit over Prop. 22

A new lawsuit claims that the recently passed Proposition 22 violates California’s constitution, leaving rideshare drivers with little pay and few options.

Labor unions, along with rideshare drivers and consumers reportedly joined in the lawsuit filed in California’s Supreme Court. In it, the plaintiffs claim that the measure strips rideshare drivers of important protections under California labor laws.

In addition, rideshare drivers who are also plaintiffs say that the newly enacted measure makes it difficult for them to make a living.

“It’s a full-time job for me but it has become challenging to earn enough money for myself and my family,” a rideshare driver and plaintiff in the lawsuit reportedly said at a news conference announcing the case. “I need a safety net and protection.”

Reportedly, the plaintiffs are seeking a fast track ruling on the case, noting that the recently enacted measure is already having deleterious effects on workers.

“We’re asking the court to give the defenders of Prop. 22 30 days to respond to the petition,” an attorney representing the plaintiffs said at the news conference. “We’re asking for an expedited consideration rather than a preliminary injunction. We expect to hear pretty quickly whether the California Supreme Court will hear the case.”

Voter Initiative Touted as Protecting Workers

Prop. 22 was only recently passed during the 2020 election cycle. It was reportedly crafted in response to a new California labor law, AB 5, that tamps down on the use of independent contractors by companies.

While labor advocates welcomed the additional protections for workers under AB 5, industry claimed that the additional protections for workers would effectively wipe out their business models. Indeed, rideshare drivers used by gig economy giants Uber and Lyft, reportedly said that implementing AB 5 would require the companies to pull out of California.

According to the Daily News, Prop. 22 was written by Lyft and Uber and supported by other companies that utilize rideshare drivers, like DoorDash, Postmates, and Instacart. The companies claimed that the measure would still provide protections to rideshare drivers, but exempt them from other mandates in AB 5.

Uber, Lyft Poured Money into Campaign

Reportedly, Prop. 22 was one of the most expensive measures in U.S. history. Uber and Lyft spent over $205 million on the campaign for the measure, which passed with 58% of the vote, according to CNET.

“Every day, rideshare drivers like me struggle to make ends meet because companies like Uber and Lyft prioritize corporate profits over our well being,” a rideshare driver and plaintiff in the lawsuit said at the news conference. “With Prop 22, they’re not just ignoring our health and safety — they’re discarding our state’s constitution.”
