bareMinerals Harmful Substance Class Action Overview:

  • Who: Shiseido Americas Corporation has been hit with a class action lawsuit over its bareMinerals makeup line.
  • What: The consumers allege that the range, which is advertised as being clean and conscious and free of harsh chemicals, actually contains harmful per- and polyfluoroalkyl substances (PFAS).
  • Where: The class action lawsuit was filed in New York federal court.

Beauty brand Shiseido’s bareMinerals makeup line, which is advertised as being clean and conscious and free of harsh chemicals, actually contains harmful per- and polyfluoroalkyl substances (PFAS), a new class action alleges.

Daian Onaka, Torshia Woods, Sheli Zeller, Margo Ferguson and Eva Bailey filed the lawsuit against Shiseido Americas Corporation alleging that the company conceals the inclusion of the manmade chemicals, falsely advertising the products to consumers and duping them into buying something they believe is natural.

All the while, the group alleges, the makeup line contains the “highly persistent and potentially harmful human-made chemicals,” which are sometimes called forever chemicals due to their pervasiveness and have been associated with a variety of negative health effects for humans and the environment.

The inclusion of the chemical in Shiseido’s makeup was made public in a study published in June that was conducted by Notre Dame researchers and published in Environmental Science & Technology Letters. It found that more than half of the makeup sold in the United States may contain the toxic materials linked to cancer, low birth weight and weakened immunity.

In a 2019 study, the U.S. Department of Health and Human Services’ National Toxicology Program found that PFAS has adverse effects on human organ systems, with the greatest impact seen in the liver and thyroid hormone, the bareMinerals class action lawsuit explains.

Shiseideo ‘Capitalizes On Ever-Increasing Consumer Demand’ For Clean Beauty Products, Plaintiffs Allege

The plaintiffs allege that Shiseido capitalizes on ever-increasing consumer demand for clean beauty products with its marketing and does not disclose anywhere that its makeups contain PFAS, “a chemical which is entirely inconsistent with its clean beauty campaign.” The group wants to represent consumers nationwide and is suing for damages and equitable remedies.

The bareMinerals makeup line includes foundation, lipstick, mascara and other makeup for the face, eyes and lips, and it is sold throughout the United States. Shiseido differentiates its products by advertising them as being free of harsh chemicals and unnecessary additives, full of natural minerals, rigorously safety tested, pure and clean, conscious beauty that’s good to your skin, good for the community and good for the planet, the plaintiffs allege.

“As a result of its brand name and marketing campaign, over the course of several decades, Defendant’s bareMinerals brand of cosmetics has unfairly gained the trust of consumers, who reasonably believe that bareMinerals products, including the PFAS Makeup, are made without non-clean or non-natural ingredients, such as PFAS,” the plaintiffs say.

They add that Shiseido does not disclose on its website, in its ingredients, on its packaging or in any other manner that its products contain PFAS.

“Defendant’s concealment of this material information makes its false and misleading marketing even more egregious,” they argue. “Defendant’s misrepresentations are intentional, or otherwise entirely careless, and render the PFAS makeup worthless or less valuable.”

The group is suing for breach of warranty, negligent misrepresentation, fraud and violations of various state business and consumer acts.

I have been using bare minerals for 20 years, all I wanted was an all natural product. This really makes me angry that we all have be lied to and misinformed. Manufacturing of poly family chemicals that have pfas needs to stop. China is a country that has been manufacturing for years. Banning pfas will not stop this chemical from making its way into products. It can help but to solve the problem manufacturers need to stop making it. So go after the manufacturers.

Started googling why Bare Minerals was out of stock everywhere I go because it has been my go-to foundation for at least 20 years. I cannot believe it has been linked to cancer, especially when it was touted as a product that was good for you. I would like to be added to the suit as well.

like many other contributors to this article, I have used bareMinerals for several years, succinctly at least five and then stopped using it for maybe another four years and was right about to go into Ulta and buy a new batch, and I decided to look up their recommended expiration dates and updates on the product to see if there was an improvement or a decline in the product and I found this class action suit. In the time that I was using bareMinerals daily, I did end up with breast cancer. I am a survivor, but I’m actually having some trouble with my liver and I’m so worried now. I am furious about being duped. That they just totally excluded the bad elements from the ingredient list is downright unlawful.

Please add me to the suite. I have been using BareMinerals for a long time, and I recently went to buy another foundation until I came upon this suit. I thought all of this time that it was clear and natural as advertised. That is what I wanted. To find out it is not is very upsetting to me!!!!

  8. Kathleen Thomas says:

Please add me to this suit, I used Bare Minerals for a vet long time because I thought they were natural and good for your skin.

  9. Michele M Pearson says:

Hearing this makes me sick! I have used bare minerals for 12 years. I was told it was clean and didn’t contain chemicals that would harm me. I have allergies to certain things and didn’t want it in my makeup. I also was diagnosed with cancer in 2020. I fought it but it came back in 2022 to my liver and lung. I wonder if it’s not from all this product I have used. Makes one wonder who they can trust when they lie to your face!!

    1. Karen Salt says:

Add me to the lawsuit! I have been using bare minerals since it first came out & the only place you could get it was on TV!!

  10. Sherry Tsft says:

I have been using bare minerals products since they came on the market. Having problems with my liver and I have to wonder if this is part of the problem? I am very concerned. Thought zi was using something safe for my body and skin!
