A class action lawsuit argues that Schwarzkopf got2b Ultra Glued Invincible Styling Gel leaves flakes in hair, despite advertising that it causes “no flakes.”

Plaintiff Abel Duran filed the class action lawsuit against Henkel of America and Henkel Corporation, claiming the company is falsely advertising its styling hair product.

According to Duran, he purchased a 6 ounce bottle of got2b styling gel for the premium price of $7.99 because he believed marketing claims that the product would not leave flakes.

He says that because the product does cause flakes, he received a less desirable product than he thought he was purchasing.

The got2b hair gel class action claims that Duran was denied the benefit of his bargain and was finically injured by the misrepresentation of the product.

Duran says that the product is worth “far less” than what he paid for it. He argues that if he encounters the product in the future, he would not be able to rely on the truthfulness of the representations on the labeling, if the company does not change its labeling of the product to make it more accurate.

The plaintiff is seeking damages on behalf of himself and all other similarly affected consumers.

According to the got2b hair gel class action, online reviews show that many consumers were misled about the nature and quality of the product because of its labeling and advertisements.

“Plaintiff’s survey of online reviews may not qualify as a rigorous scientific study, but it does demonstrate that Plaintiff’s negative experiences with the Product were not uncommon and that their disappointment was not purely subjective,” the got2b hair product class action lawsuit states.

Duran also seeks an injunction barring the company from misrepresenting the product in the future.

Duran says that he intentionally purchased the got2b styling gel as opposed to another product because he wanted to avoid the gel flakes that are commonly produced by hair gel.

However, he says that after the gel dried, he noticed that it had produced white and grayish flakes, similar to dried glue.

Duran says that he did not have such flakes in his hair prior to applying the product, because he inspected his hair before applying it.

He says that he would have known whether his head produced the flakes because natural flakes and gel flakes are different in their texture, color, shape, and nature.

Additionally, the got2b styling gel class action lawsuit argues that based on consumer reviews, and the fact that the ingredients are known to cause flakes, the company knew or should have known that the product would cause flakes, but misrepresented the product nonetheless.
