A class action lawsuit says that a line of “high performance naturals” beauty products is falsely advertised, and in fact contains synthetic ingredients.
Plaintiff Jeannie Patora says that she purchased Tarte cosmetics at a Sephora store in Poughkeepsie, N.Y. Patora claims that, at least in part, she purchased the products because of an advertisement that said that they were “natural,” which led her to believe that they did not contain any synthetic ingredients.
However, Patora argues that after she purchased the products, she learned that they contained a range of synthetic ingredients. She says that had the products been accurately represented in their packaging and labels as containing synthetic ingredients, she would not have purchased them or would not have paid as much for them as she did. Based on this, she claims that she was financially injured by Tarte Inc., the makers of the products.
Patora seeks damages for herself and on behalf of all other customers who thought they were buying all natural cosmetic products. According to Patora, many reasonable consumers could have been misled by the products’ advertising and packaging into thinking that the products contained no synthetic chemicals.
Patora also says that Tarte Inc. should be required to change their packaging. She says that she would consider purchasing the products again if she could be assured that the products would be faithfully represented in the future. Without an injunction barring the company from misrepresenting its products, Patora says she cannot be sure that Tarte cosmetics are not misrepresented.
According to the Tarte cosmetics class action lawsuit, the Tarte products should not be labeled as “natural” because they contain synthetic, or man made ingredients. Allegedly, consumers generally understand the term “natural” to mean that the product contains ingredients that are not synthetically produced.
The Tarte cosmetics class action lawsuit goes on to say that consumers have a strong preference for natural products over those that contain synthetic ingredients, because natural ingredients are seen as better for one’s heath, better for the environment, and of higher quality than synthetic ingredients.
Allegedly, Tarte Inc. was aware of this consumer trend, and advertised their products as natural in an effort to encourage consumers to purchase Tarte cosmetics over competing products. However, the Tarte cosmetics class action lawsuit argues that the company misled customers into thinking they were receiving a more desirable product than they really were.
As a result, Patora says that the profits that Tarte gained from the sale of the “high performance naturals” was unjustly gained. She says that Tarte should be forced to disgorge the profits the company gained from the sales of the “high performance naturals” products.
