Toyota Tundra fuel leak class action lawsuit overview:ย

Toyota Motor North America manufactured and sold model year 2022-2023 Toyota Tundra vehicles containing defective fuel lines that present a โ€œmassive fire risk,โ€ a new class action lawsuit alleges.ย 

Plaintiff Benjamin Murphy claims the fuel lines in the Toyota Tundra vehicles rub against their brake lines, causing the fuel lines to leak gasoline in both liquid and vapor form and present a fire risk.ย 

โ€œBoth vapor and liquid gasoline are highly flammable and present a ready danger when exposed to any sort of ignition source,โ€ the Toyota class action states.ย 

Toyota issued a recall for almost 170,000 of its model year 2022-2023 Toyota Tundra vehicles earlier this month on account of the alleged fuel line defect, according to the Toyota class action.ย 

Murphy wants to represent a nationwide class and Mississippi subclass of consumers who have purchased or leased a model year 2022-2023 Toyota Tundra vehicle.ย 

Toyota Tundraโ€™s alleged fuel line defect harms the environment, says class action

Murphy argues the Toyota Tundra vehiclesโ€™ alleged fuel line defect also harms the environment by lessening a driverโ€™s miles per tank, potentially causing them to โ€œwaste millions of gallons of gas that would not otherwise be used.โ€ย 

โ€œThis is a harm to the public good both economically and environmentally given the volatile nature of the earthโ€™s climate and domestic gas prices,โ€ the Toyota class action states.ย 

Murphy claims Toyota is guilty of negligence, unjust enrichment, fraud by omission or fraudulent concealment, negligent design defect, breach of express warranty, breach of implied warranty of merchantability, and of violating the Magnuson-Moss Warranty Act.ย 

The plaintiff is demanding a jury trial and requesting declaratory relief along with an award of actual, general, special, incidental, statutory, and consequential damages for himself and all class members.ย 

In another case involving Toyota, the automaker agreed to a class action settlement in October 2022 to resolve claims that certain Toyota and Lexus vehicles were equipped with a defective Denso fuel pump.ย
