Best Buy Insignia air fryers class action lawsuit overview:

Best Buy sent replacement inner pots for recalled Insignia air fryers that held “substantially” less volume than the original ones, a new class action lawsuit alleges. 

Plaintiff Waneta Willis’ class action lawsuit claims Best Buy failed to disclose in an October 2023 recall notice that the replacement pots for the recalled Insignia air fryers would be smaller — as apparently necessary to make the devices safe. 

“Therefore, to make their pressure cookers functionally safe for household use, consumers are forced to accept a replacement pot with less volume than what they purchased,” the Best Buy class action says. 

Best Buy issued the recall over worries hot foods and liquids could be ejected from the recalled Insignia air fryers under certain conditions as a result of incorrect volume markings on the inner pots, according to the recall. 

Willis wants to represent a nationwide class of consumers who purchased the recalled Insignia air fryers, a subclass of those who also received a replacement inner pot from Best Buy via its recall and several other classes and subclasses involving multiple U.S. states. 

No refunds offered for recalled Best Buy Insignia air fryers, class action claims

Willis argues Best Buy also informed consumers in the recall that it would not be providing any refunds for the recalled air fryers, “thereby eliminating a consumers’ ability to elect a refund should they not want to accept a smaller pot than that which they purchased.” 

“As a result of Defendant’s misconduct, misrepresentations and omissions, Plaintiff and putative Class Members have suffered injury in fact, including economic damages,” the Best Buy class action says. 

Willis claims Best Buy is guilty of breach of express warranties, breach of implied warranty of merchantability and unjust enrichment/quasi-contract, and of violating the Minnesota Prevention of Consumer Fraud Act, Minnesota Unlawful Trade Practices Act and Illinois Consumer Fraud and Deceptive Practices Act

The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of punitive damages for herself and all class members.

    I received the replacement pot for the Insignia air fryer. It is smaller than the original pot, therefore, it doesn’t fully serve the purpose that I originally bought it for.

    I did purchase my Insignia air fryer from “Best Buy”, it stopped working. I no longer had the receipt so I threw it away. Unfortunately because of scammers & greed, honest hardworking people have to take a loss. My advice, keep your receipts as safe as possible
