Ferragamo belt class action lawsuit overview:
- Who: Scott Fineman, Mohammed Waqas Malik, Cristian Silva and James McGriff filed a class action lawsuit against Ferragamo USA Inc., Sator Realty Inc., Saks Fifth Avenue LLC and The Neiman Marcus Group LLC.
- Why: Fineman, Malik, Silva and McGriff claim Ferragamo brand “luxury” belt buckles quickly become discolored and/or tarnished.
- Where: The class action lawsuit was filed in Florida federal court.
Luxury designer belts manufactured and sold by Ferragamo USA contain defective belt buckles that cause the product to “quickly become worthless for their intended purchase as fashion accessories,” a new class action lawsuit alleges.
Plaintiffs Scott Fineman, Mohammed Waqas Malik, Cristian Silva and James McGriff claim Ferragamo sells belts containing the defective buckles for “many hundreds of dollars” due to their “supposed superior quality and luxury status.”
Fineman, Malik, Silva and McGriff argue the Ferragamo belt buckles are defectively manufactured and/or designed since the “iconic” metal belt buckle “quickly becomes discolored and/or tarnished.”
“This discoloration and/or tarnishing occurs regardless of the way in which customers use and care for the Belt Buckles and cannot be blamed on the consumers – it is a defect in the design or manufacturing of the Belt Buckles themselves,” the Ferragamo class action states.
Ferragamo belt buckles become ‘unsightly,’ ‘aesthetically unappealing,’ ‘useless,’ class action says
The alleged defect renders the Ferragamo belt buckles “unsightly, aesthetically unappealing and ultimately useless” for its intended purpose of providing a “luxurious’ fashion accessory,” according to the Ferragamo class action.
The plaintiffs allege Ferragamo, along with Sator, Saks Fifth Avenue and Neiman Marcus, are guilty of unjust enrichment and violate the Florida Unfair and Deceptive Trade Practices Act, among other things.
They demand a jury trial and request declaratory and injunctive relief along with an award of compensatory and actual damages for themselves and all class members.
Fineman, Malik, Silva and McGriff want to represent a nationwide class of consumers who have purchased one or more Ferragamo belt buckles, either alone or as part of a belt, from a physical Sator, Saks Fifth Avenue or Neiman Marcus retail store.
