A $750,000 settlement has been reached in a class action lawsuit alleging New Balance shoes contain a misleading “Made in the USA” label.

If you purchased New Balance shoes with a “Made in the USA” label between Dec. 27, 2012 through Jan. 24, 2019 in California, you could get up to $10 per pair from this class action settlement.

The models included under the terms of the class action settlement are listed below in the Who’s Eligible section, as well as on the settlement website.

A class action lawsuit alleged that New Balance violated California consumer protection laws with respect to its “made in the USA” labeled shoes because these shoes are in part made with foreign components, according to the New Balance class action lawsuit.

The New Balance athletic shoes class action lawsuit pointed out that, in addition to being made of non-USA parts, much of the labor used to make the components of New Balance shoes occurred outside of the United States as well.

The parties reached a settlement agreement in October 2018, but a federal judge demanded additional clarity. In early 2019, the California New Balance class action settlement was preliminarily approved.

Under the terms of the class action settlement, New Balance will pay Class Members who provide proof of purchase with up to $10 per pair of eligible shoes for up to five pairs per individual or 10 per household. Class Members without proof of purchase can claim one pair of shoes for up to $10. The precise amounts paid to settlement class members may vary depending on the number of claims submitted.

Those without proof of purchase must provide the shoe model, store location, and date of purchase. Class Members claiming up to five purchases must furnish proof, including a receipt, picture of the shoes, or copy of a credit or debit card statement to get the full benefit of this settlement.

In addition to the monetary compensation, New Balance has also agreed to no longer use the phrase “Made in the USA” on the front of the tag or on the outside of the shoe box.

“On the back, in clear readable font, the hangtag will include the following sentence, or words to similar effect, ‘New Balance ‘made’ is a premium collection that contains domestic value of 70% or greater,'” the New Balance class action settlement states.

Class Members who want to submit claims or wish to be excluded from the settlement, must do so by May 6, 2019.

Who’s Eligible

Class Members include those who purchased New Balance shoes in California between Dec. 27, 2012 through Jan. 24, 2019.

Eligible shoes include the following models: 601, ML996, M1140, ML997, M1290, MR1105, M1300, MR993, M1400, MW812, M1540, PM15, M1700, PM16, M2040, US574, M3040, US576, M498, US990, M574, US993, M585, US998, M587, W1140, M770, W1290, M990, W1400, M991, W1540, M995, W3040, M996, W498, M997, W587, M9975, W990, M998, W998, MK706, WK706, ML1300, WR993, ML1978, and WW812.

Potential Award

Up to $10 per pair.

Class Members who do not submit proof of purchase can receive up to $10 for one pair of New Balance shoes. Consumers who are able to provide receipts, photos or bank statements can file a claim for up to $50 per person or $100 per household.

Proof of Purchase

Class Members claiming more than one purchase must provide proof, including either a receipt, picture of the shoes, or a copy of a bank statement.
